Remortgage with ccj

Hi all,
me and the wife are about to try to remortgage our house to raise some capital for home improvements
- the problem is the mortgage is only in my wifes name but in order to get the extra capital I will have to be added to the mortgage
- unfortunately I have a ccj through no fault of my own as a car I sold the new owner didnt bother to tax!!! I then moved addresses and never recieved the notification - this happened over 4 years ago
- I did try to pay it but the DVLA are completely useless and made it near impossible to do so rather then jump through there hoops it left it.
The amount is for £100 - my question is this

Will the ccj (even for such a small amount and over 4yrs ago) have any effect on our chances of a remortgage? As stated I am only being added to the mortgage to get the extra amount. Also since the ccj I have also been accepted for several credit cards - even American Express (which I was told was difficult to get if you had bad credit)

    YOu should be fine with most lenders for £100

    SOme lenders will still be very picky in the current climate, but you should be able to get a good deal - although you do not put the figures needed

    Thanks for that, were looking at increasing our mortgage from 115k to 195k with a valuation of 220k which brings us in at under 90% LTV.

    I know the figures are a little tight we need to cross our fingers that the valuation comes in at the 220k mark.

    We have heard that alot of mortgage companys are down valuing in the current climate - we have a 4 bed extended detached with detached garage over looking a golf course in a nice area close to Oldham - where can you buy a house like that for 220k??? :confused:

    Out of no other reason other than sheer noisyness what are you getting done that costs 80K. I was thinking from your first post an extension, but surely not?

    Hi, its no problem, we have already had the work done (parents gave us the money) and we would now like to give it them back. We had a loft conversion done creating a 4th bedroom with ensuite (which has a wonderful juliet balcony over looking the golf course), an extension to the rear of the house giving a bigger living room and kitchen and had the garage built.

    Sounds absolutely fantastic, and a lot of work for the money. Good luck in getting the mortgage sorted (sorry for not being more helpful!)
  • Let me get this straight - the DVLA took you to court over a car you sold? For unpaid tax? I'm sorry, that's outrageous!! It annoys me that a statutory agency will do that to an individual irrespect of the amount. The DVLA are basically civil servants - always remember Civil Servants don't agree to anything over the phone. You should complain in writing to the DVLA - if you can demonstrate that the car was sold prior to the CCJ, then you should ask them to explain how and why they decided to take you to court as you were not the registered keeper of the car.Don't forget if you put it in writing you will not be ignored.This was not your fault, and too often these situations are accepted without question. You could not be reasonably expected to know that a court summons was issued against you since you moved house. Had you known you could have taken action.
    I would complain to high heaven over this.This should not take a lot of time but I would think its well worth a shot.
