CCA request success stories

Anyone sent a CCA request to their credit card company, who failed to provide, and then got some, if not all of the debt wiped off?
Also, what did you do when the company failed to provided the CCA? How did you approach them then? Whats been the final outcome?

Hi
Yes Ive had a couple of them completely wrote off, I wrote asking for the original CCA back on the 5th Aug 08 and basically had nothing till the last moment with one of them, which was not what i asked for. I then sent out a 2nd letter saying what they had sent me wasnt the actual agreement it was merely just a photocopy of something that was what i would have signed. I know i did not sign the agreements since i took it out over the net in 2000. I mainly CCA'd my catalogue debts since they make up most my debts. I had £481 wrote off with one, and £812 wrote off with another. They simply replied to my 2nd letter saying that they will not be pursuing the account no further but cos the debt wasnt satisfied they will record it with the credit ref agencies. This i am not really bothered much about since its there for 6 years, and at least it will stop me in future getting anything on credit and getting in way over my head. I will be advising them though in a 3rd letter that since the debt was unenforceable they can not issue a default notice as it will be in breach of section 13.6 of the banking code which does stipulate that you can only register information if the amount owed is not is dispute. I had my write off letters back this past 2 weeks so its not took too long for them to reply and write them off. I thought it would be a long process drawn out. I still have quite a few that have not sent them or refusing to send them but the accounts are on hold till further notice till they produce which i know they cant cos i never had one to start with. I have just one credit card ive cca'd which may produce and that too is on hold with cabot who have advised they have requested the info so its basically stalemate just now. A waiting game. Be prepared though, i have brown envelopes for every creditor with every letter they have sent and my reply in it to keep on top of things and make it easier to look for when you do get that reply. Remember to add your dates and NEVER SIGN just print your name on the bottom that way if things did go further ie Court then they may be able to lift your signature and put it on something cos i wouldnt put it past them and this day and age its very easy to do.0 -
