This happened to a friend of mine - not long before she was due to get married it all fell apart and she found out that her fiance had been taking out loans in both her name and her parents name (at their address) and had forged signatures etc to do it. I can't remember unfortunately, what the outcome was, but at least you know you aren't the only person who has had it done to them. Men can be so weak, can't they?0

Hi there, just an update. Moorcroft are still being really horrible and nasty. I have been doing a lot of research on the internet and the National Debtline website stated that if I haven't signed a credit agreement, which I haven't, then it is not enforceable. Does anyone think that this is a route I could take? Does this involve sending an SAR letter and if so can anyone help provide me with a template so I can try and get the message across to these people that are harrassing me? Any help would be greatly appreciated. Many thanks again x x0

Hi RainbowandFlowers
Firstly, I am really sorry that you are going through this - it must be so stressful.
I haven't got particular advice about the types of letters you need to write but I am concerned that as this is not your debt you need to get proper legal advice. I really think that you should try and contact and get advice from the CAB. This is an issue of fraud and not of a debt that you have incurred.
Get as much information about the companies and what information they hold on you. As well as asking for copies of the Credit Agreements I wonder if you should also ask them for a statement of the items it thinks you have ordered. (Others may have a view of this as it may also suggest to the companies that you are acknowledging that the debt may in fact be yours).
This is a really tricky situation and I really think that you need a professional who can help you through the full process. It might also be useful to see if you can provide evidence of your ex moving out (i.e. requests for change of Council Tax status or removal from the electoral roll).
I'm not sure if this really is helpful - they are just ideas.
I wish you well with this.

hi
not an expert on this, please get "proper"advice, such as a free half hour with a solicitor or cab. I think that you should not request anything since you are saying that this is a crime,as in fraud, done in your identity. I think that once you have written stating this ( recorded delivery) then inform the police.
don't enter into any sort of conversation with the companies.
you have been the victim of a crime, you are not the criminal.
get proper help as soon as possible.
good luck, keep us all informed.LBM-2003ish

you can search the forum for the CCA and SAR templates. Go to the DFW threads front page and on the top right there is a 'search this forum' button. You type in what you want to search for there.Cats don't have owners - they have staff!!
