letter from Mackenzie Hall

About 6 weeks ago maybe more I received a letter from Mckenzie Hall. It was basically trying to find out if I lived at the property etc and if I would call them to confirm this.

I researched on here and other forums and decided not to contact them upon the advice of others.

I have since received a letter from Mackenzie Hall it reads as follows:

"Ref No:*******
Pursuers: Lowell Portfolio 1 Limited
Sum: £105

Despite previous correspondances you have failed to respond. We have obtained this alternative address as a financial link, linking this address to your previous abode. This financial link was provided by a credit reference agency.

We have been instructed by our client to recover this overdue account on their behalf.

Our clients have informed us that they are unaware of any legitimate reason for non payment of their account and although they would prefer an amicable settlement, they will not hesitate to take further action as may be appropriate.

We trust that this will not be necessary and would request that you send your payment by the deadline below, via the enclosed business reply envelope.

(PAYMENT DEADLINE: NOON 10TH OCTOBER 2008)

Yours Sincerely

A LOWE"

Now the last correspondance was sent to the same address, so I am puzzled to their quotation "we obtained this as an alternative address"

As Lowell are a DCA, why are Mckenzie Hall chasing me?

Also what is this supposed debt, it only says the pursuers are Lowell Portfolio??

I know who all my current debtors are and am receiveing regular correspondance from them

I am not aware of any old debts outstanding, surely if there were I would have had correspondance from the debtors themselves initially? something which i have never had.

Im very very worried, should I contact them?

Cheers!

  • Don't phone them!!!!!
See thread - Old Debt Mackenzie Hall and read more about them.(think it's 2-3 pages back!!)
You need to send them a letter - templates on thread to request a copy of the signed agreement - they have 12 days to respond back to you with a signed copy of the agreement.
MH buy old debt and try to bully people into paying.
I've dealt with them on behalf of hubby and wouldn't trust them at all.
Mortgage free as at 1/9/13 :j

    Hi
Could be that MH are "fishing". They could have a debt from someone who they are unable to trace and are sending letters to people with the same or similar names. If you phone them, they will look at this as you admitting that you owe the money and will bully you into paying.
    Do not phone them.

I would suggest that you sit tight and see what happens next, if anything.

  • Thanks for that info Sunny Donny, I have read up on it all but everyone elses letters seemed to be different to this one so I was a little concerned

How can they get information from credit ref agencies and then send letters like this without even specifying who the debt is owed to? Its all very underhand.

If they had specified the debtor and it had registered as being genuine, then I would not have hesitated to sort it out!

Do you reckon they will be able to provide a copy of the CCA or is this more than likely scare tactics?

could it end up in court if I make no contact, seems as it has been sent to my name and address?

It may have been sent to your name and address as well as a lot of others. My ex OH had the mis-fortune of dealing with this bunch of t*****s (sorry about the language!). He made the mistake of phoning them and they bullied him into paying a debt that was not his - just think how much money they make if everyone who receives a letter like this, calls them?

I would still be inclined to sit tight and see what happens. If they send a letter threatening court action then CCA them then and see what they come back with. MH specialise in buying old and unenforceable debt so I doubt they will be able to provide you with a valid CCA - in which case you can tell them to bog off.
