Gym Membership - Cancellation - HELP!

Hi all, Apologies in advance if I am posting this in the wrong section. ***I joined Esporta in July. I am 100% certain the guy inducting me said I had to give 1 months written notice to cancel. I was wanting to cancel at the end of this month, but when I asked the receptionist, I was told it was 3 months notice and it had been 3 months for over 3 years. I was told to check the agreement I signed. I checked this and it did say 3 months. However, I am not prepared to fork out 3 x £70 for the next 3 months. ***I know I signed the contract, which I should have read in detail before I did, but it was one of those last minute things. And I am still adamant the guy said it was 1 months written notice. ***Anyone know if I can somehow cancel my membership or will I have to stay on for the full 3 months? Also, I think the gym is atrocious and that the instructors just stand around in a corner chatting away. One of the reasons I am wanting to cancel my membership! Plus I have had 3 sessions with the instructors and they have all given me totally bizarre programmes. The 1st one was so lame, a 10 year old girl could have done it. The 2nd was very very complex. The 3rd one was just mental, I was expected to stay in the gym for over 2 hours each time I went. Could I use this as a factor and say I want my membership cancelling immediately or something? ***Hope someone can help me with this. ***Cheers in advance.

  • Hi Mimi - I just wanted to tell you I had the exact same experience with Esporta. Like you I signed the 12 month contract, wrongly assuming it would be a month's notice. When I had completed 12 months I sent my one month's notice in and after that had finished cancelled my direct debit. They contacted me to say it was 3months notice and I would have to pay off the remaining 2 months. I refused and they threatened me on the phone with baliffs. I was really worried but everyone said "oh they won't do anything about it". Anyway, my friend was cancelling at the same time, and they got a baliffs letter, so ended up paying the notice period plus a baliff's fee! After hearing that I ended up paying up, as I didn't want to pay more for the baliffs, and was worried about my credit rating.

    I now tell everyone not to join Esporta, because of their bully-boy tactics.

    I'm afraid I think you will have to pay it - I expect they get this a lot and don't think twice about getting debt collectors involved. In all I found it a very worrying time and will think twice before I sign up to anything again!

    I think their contract is pretty watertight. I doubt there is any term that says "if you don't like the gym, we'll reduce the notice period".
