ScotCall Det Collecing Services

Hi, a friend has received a letter - doorstep Collection Notice - from ScotCall saying the outstanding Debt has now been placed with them, and that unless full payment is made the account will be passed to a field agent to arrange a doorstep call.

This is the first she has be told of the debt being passed to ScottCall. As far as she was concerned the dept was with Equidebt.

Does she have to speak to the person it they turn up?

All advise greatfully received!

    Hi
Don't wish to scare you but Scotcall may send someone. They did to me. Doorstep collectors have no legal rights (although they say they have!). Do not let them in, and if they do turn up - tell them to bog off! Your friend does not need to discuss anything with them, in fact doesn't even need to answer the door.

If they refuse to leave, call the police. I did and they soon scarpered!

Thanks Deep in Dept. Should she request a CCA from Equifax who holds the debt?

Not sure on this one as I was lead to believe that Scotcall are not actually a DCA but supply doorstep collectors to creditors, so were not actually holding the debt but sending a gormless meat head to scare me into paying. Scotcall appeared on my front doorstep, but my debt was actually with Barclaycard/Mercers at the time.

I would be inclined to CCA the creditor.

You should send the CCA to whoever is chasing you for the money. Scotcall are obliged to pass your request for CCA to the creditors (S175) - you are not required to do the legwork.

Just checking - can she request the CCA? Credit card or loan is ok, not an overdraft. Also there was a change in the legislation for debts signed after April 2007 - will this have any bearing?

The debt is a loan with HBOS which was handed to Blair, Oliver and Scott Ltd and then to Buchanan Clark & Wells, then to Equidebt. And now this letter from ScottCall. The loan was taken out in 2002.

I would CCA Equidebt then. As I say, I believe Scotcall send morons round to try and scare you but don't actually hold the debt.
