Hi peeps,
I am new to this site so bare with me. After reading all the advice on here i feel a bit more clued up on my rights, the day before my birthday i had a letter from Thames and i think formerly known as Aktive Capital, saying i owed another debt, 2 i had previously cleared early this year, i plucked up courage and found out it didnt have a CCJ on it and was over 6 yrs old so i quoted the Statute of Limitations act and thank god it worked and was written off.......but, the debt i am really worried about is a £4,000 unsecured loan from NatWest and defaulted in 2002, thing is i have checked my experian and although i know a ccj is there it wont come up as experian say the address is the same but input is wrong, and she wouldnt tell me how much it is for....So i cant tell if this ccj is for the 4,000 loan....if it is and i suspect it is what would be the procedure if and when the debt collectors eventually write to me about this debt, do i ask for proof of the ccj and that they can enforce this, i'm a student nurse now and i am in no situation to pay this debt, any advice on how to deal with this would be much apreciated!

To see if you have a CCJ, you might be able to get that information from the registry trust https://www.registry-trust.org.uk
Alternatively, you might be able to contact the court if it gives you the case number to get the details.
If you received no notification of the CCJ originally, you amy be able to ask for it to be set aside so that you can put in a defence. I would then request a copy of the CCA to make sure the debt was enforcable. If however 6 years pass after the CCJ was issued, then it is not statute barred, but the DCA would need to apply to the court for permission to enforce the CCJ.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
