mis-priced

HI

I order a DVD box set but HMV cancel the order saying it was mispriced.
Can I still get the box set at the lower price?

We are very sorry, but it has come to our attention that the item appeared
on our web site with the incorrect price of £16.99, instead of £49.99. We
will not therefore process your order.

The terms and conditions governing our online sales state that your order
is only accepted, and a contract between us formed, when HMV receive
payment for the goods you have ordered. HMV have not yet taken payment for
the goods listed above, nor taken the final step of confirming the shipment
of your order to you by email (please see point b. in the section entitled
‘The Contract between US’ on the first page of our Terms and Conditions.
We are therefore under no legal obligation to sell the item to you at the
incorrect price. [FONT=&quot][/FONT]

    no you can't, not from HMV anyway, they mispriced it and have chosen not to sell it to you unless you want to pay the proper price.

    Its been asked many times befire and replied with

    buying goods for shops online or not is a 'invitation to treat' both the customer and the shop and come out of the deal at any time unless money changes hands

    no. When things are mispriced there are 2 options for the selling company, 1) to sell at the price advertised or 2) to refuse the sale
    If my typing is pants or I seem partcuarly blunt, please excuse me, it physically hurts to type. :wall: If I seem a bit random and don't make a lot of sense, it may have something to do with the voice recognition software that I'm using!

    Correct me if I'm wrong but the offer to treat is a invitation to make an offer for the product. Once you have added this to your basket and purchased it. Does this not suffice as an acceptance of the offer therefore on this basis a contract has been formed binding them to sell the product.

    Edit: Ignore me original post states they haven't taken payment.
