  • I've just won a tribunal case for backdating a claim. The maximum is 3 months. My claim was for 15 months. I did get the 15 months ni contributions tho. Persevere.

Hi. I'd love to hear the details - on what grounds were you backdating please?

Well done - hope it was a valid reason though! :p

The only reason I know for backdating of JSA is being told you were not eligible and you were, and you can prove it.

twaie is a new poster so without some kind of backup or details of the case to prove his/her story, I would ignore it.

I was made redundant at the start of the year and rang the job centre up pretty much straight away to ask about JSA because I wasn't sure if I would be allowed it because I had savings, the person on the phone told me that no I wasn't entitled to it because i'd got money in the bank. A few months later I was told by a family friend that everyone can claim JSA regardless of savings it is just contributions based not income based (By the way income based is the worst name in the world, what income do you have if you're unemployed? should be savings based as that is clearly what it is) anyway I got straight on to it and made an application and applied for it to be back dated. The reason I gave was that I had been incorrectly informed that I couldn't claim by a job centre employee and had made a claim the moment I became aware that I in fact could. I was turned down as they said I didn't give a good reason for not claiming.

Income based takes into consideration ANY type of income into the household - hence the name
