MBNA default, can anyone give me some advice?

I had a default notice from MBNA at the start of September, saying if I don't pay the arrears by the 19th the following action may be taken, then going on to say they may go to court.

Do I need to do anything? I've sent a copy of the default notice to Payplan. Is it worth writing to them to see if the offer to pay another £15 per month over and above the DMP amount still stands? Should I ask for a copy of the CCA? The card was originally with A&L but was taken over by MBNA some years ago, and I've had it for at least 16 years.

At the moment I haven't heard anything further from MBNA, I did write to them to say I'm with Payplan and the amount they're getting is the amount pro rata from my DMP payments when the default notice came thorugh.

    If thats what payplan said you can pay, then dont pay them anymore.

    It may be worth asking for your CCA, especially with the account being that old, chances are they haven't got tit any longer.

    I wouldnt worry about the court action threat, I have never known anyone get taken to court directly by them, they always sell the account on to a debt collection agency.

    Have you reclaimed your charges from them? - If you send in the first letter asking for a refund, they will refund everything over the last 6 years down to £12 - send the second letter, and you will get all your charges, plus compound contract interest. This will probably get credited to your account, but depending on your balance, it could even clear it and give you a few quid.

    I actually work there (for my sins) so know it to be true
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

    I would definately request a copy of the CCA. After 12 working days, the debt is unenforcable and can only be enforced with a court order. If they were to go to court without providing a copy, it would definately not look good for them.

  • Thank you both, I will send off for the CCA today. I haven't had any charges in the past 6 years to claim back until I started having problems, I've always been up to date with my payments so havent been charged until I started having difficulty paying.

    Still nothing in the post from them today, so I'm still hoping the debt gets sold to a DCA. I'm a bit stressed about this one especially as of my 5 main creditors, I owe MBNA the second smallest amount and the ones I owe the most to have been really helpful!
