Favourite jeans ruined already!

I'm not sure if this is the right place to post this, but I bought a pair of jeans from Oasis about 2-3 months ago which cost £45. I haven't worn them much as I wanted to save them for 'best'! I went to put them on earlier today and noticed there's a hole in them just above one of the back pockets. It was about 1cm across. I wore them regardless as I was in a rush and, of course, it's now grown to double the size! Denim is a hard-wearing material and shouldn't just wear like that. I know I haven't caught them on anything. However, I know that if I try and take them back to Oasis they won't want to give me a refund as they weren't damaged when I bought them. I bought them on my Virgin credit card. Does anyone know if I have any comeback at all?

Take them back to the store where you bought them, together with
proof of purchase.

Tell them how upset you are that the your lovely Oasis jeans are falling
apart in such a short period. (Whilst remaining cool and polite, but firm.)

See what they say. Ask to see the manager if you get no satifaction
from other staff. It could be that there is known product fault.

It doesn't appear your jeans are of merchantable quality.

I'm sure they'll do the right thing.

The sale of goods act states that goods must be of merchantable quality. If you can prove the date of purchase, or the goods are especially seasonal and the store knows when you bought them, they will most likely offer you a refund or exchange. Stores can tell when jeans have not been worn much, and they probably make sure they were the right size for you. Jeans that are too tight can put pressure on places where pressure should not be, and this can lead to ripping. (I am sure this is not the case, but I do know they check for this as Mark One did when I took my eldest's back on a similar basis)

If this fails, your local trading standards can assist. Sections 56 & 75 of the consumer credit act can offer additional support, but I think that the value of your purchase falls under this threshold.

I see no reason why dealing with the store directly should fail - they're a big brand and no doubt value their reputation

I found this happens alot with jeans i have purchased from asda, one cheeky customer services staff said had i tried getting a bigger size!!! Wouldn't have minded but i could slide them off without undoing them. They had said i could exchange them but no refund given.

As they where bought on a Credit Card and cost less than £100. the Consumer Credit Act is of no use.

However the Sale of Goods Act,(SoGA) is, and has been said, " It doesn't appear your jeans are of merchantable quality." also they are "not fit for purpose"

i used to work for next and every now and then we would have things returned with a hole in it. It is usually wear the shop puts the security tag through the garment. Depending on where the tag is put and what type of material it is, sometimes after a few washes and wears the hole seems to get bigger. I'd definately say return it you have nothing to lose!
