Have I done something wrong?

Hi, all,

Cut it short, I have a DMP with CCCS, and those lovely people at Moorcroft have 2 accounts on there.

now I have never missed a payment and with 2 babies have been paying the minimum of £5.00, and Moorcroft (non of the others) paid me a house visit twice in 2 weeks!

so I have to fight back I thought:A

Asked them for the Original Signed agreement

Got a letter this Saturday saying they have placed the 2 accounts on hold they are in dispute!

And NO, no sign of the signed agreement, surprise eh!

Will have to inform CCCS about this to suspend payments to them

Have I done wrong doing this?

Will CCCS shut down my DMP?

To be honest just want them STOP knocking on my door when the account was being paid!!!

What do you think?

k.

  • Hi,
I believe they'll suspend payments for a while but will want a final resolution on it. Worth having a chat with them but I think they'll still want the same amount for the DMP, they'll just spread the extra over the other creditors.

They shouldn't shut down your DMP simply due to the fact you've done something that is your legal right!
  • By requesting to see the CCA will this pee off the creditor thou and force or perusade them into taking court action quicker?

If they can't produce the CCA then even though it may pee them off they can't legally start court action. If they do then non-production of a CCA is a defence against it.

If you look through the threads when they can't produce a CCA it usually gets passed back to the original creditor.

  • Yep it annoys them expect it to be passed to anothe DCA if they can't find it. Yes its against the law to pass it on but the CCA laws were there to protect people against debtr they didn't owe not debt they did.
