If I agree a County Court Claim is a CCJ guaranteed?

Quick question please if you dont mind, I'm reading thru lots of threads trying to get some advice about a Claim form that I've been sent from Northampton County Court regarding a debt I owe to Tesco Personal Finance, or rather their collectors Incasso LLP now.

I accept that I owe the money but would like them to agree to the money repayments that I've offered via my DMP with CCCS.

I think that my only option is to accept the claim but was wondering if this meant that I was guaranteed to get a CCJ filed against me?

I was hoping to get sorted before it ever got to a court, i know my credit file is ruined and I can accept that but a ccj against my name from a court would make me feel like a criminal :( even worse than I do now.

Anyone got a straight answer to a round about question to put me out of my misery and so I know where I stand?

  • wouldn't CCCS be dealing with this?

    best out in a defence that they are negotiating with them (and other) creditors, so doing a ccj may not get any more..

    though they may just be covering their backs, in case CCCS pymts arent kept up?

  • No. CCCSwill help you with the forms by advising you what to fill in. They usually advise you to admit the debt.

    Tot, How old is the Tesco debt and what type of account is it? Is it a loan, overdraft or credit card?

    Its a loan debt that I've had for about 18months but now cant afford to repay any longer. I'll ring the CCCS on monday morning because I want to pay off my debts and I know that my credit file is ruined, I just dont want to have a CCJ.

    Maybe its just a stupid pride thing, not that I've got much of that left but I just wanna get my head down and work off my debts.

  • sorry that i dont have anything positve to say on this but i just wanted to let you know our story. We are on a DMP with cccs and one of our debts with egg ended up as a charging order from a ccj and we only missed 1 payment before going on a dmp.Egg had an obvious end goal, making sure the debt would be secured. They were just not interested in us trying to pay debt back. I dont think its very likely that you wont be given a ccj as this is usually what the company is pushing for (i think more so in the current climate).cccs were great helping us through everything and the lady even said they are seeing more and more companies going for ccj's and co's.
    sorry i haven't said anything particually positive but i just wish maybe i had know exactly what i had in store when i first started my dmp.
