I am losing my bottle

I have contacted cccs and ndl about my debt, and the fact that I got my credit cards by telling them that I was working when I was not.
I owe about 45k on 8 cards and 2 loans. They have told me that the card companys may not delve to deeply, but I am very afraid of going to jail because of this, and no one knows what is going to happen, I change my mind by the hour if not the minute, I am waiting for the help packs to arrive, I thought they may of came today, but no, so know I am bottling out.
I am at my witts end.
Please give me any advice you can.
Thank you in advance of help from you nice people on this forum.
Thank you

    H WAS :hello:

Welcome to the forum, I know you're stressed out, but take a deep breath you've come to the right place for assistance.

First and foremost, I suggest you request a CCA from each one of your creditors, before we start advising what steps to take.

If any of your creditors fail to produce a CCA, your debt becomes unenforceable, this is not written off, just means they have no legal right to harass you for payment.

So, as I say, request your CCA first and we'll take it from there, send the following letter to each one of your creditors with a £1.00 postal order enclosed in each request:

    Loan or CC Company
    Address

    Your Address

    Date

    Dear Sir/Madam

    Re:− Account/Reference Number XXXXXXXXXXXXXXXXXX

With reference to the above agreement, I would be grateful if you would send us a copy of this credit agreement.

I understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement on request.

I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

I understand a copy of our credit agreement should be supplied within 12 working days.

I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

I look forward to hearing from you.

  • hi WAS, youve taken the 1st steps to getting this sorted out, i had to wait for cccs also and wanted it all sorted in a day. unfortunately it takes a little longer.

if you have an interview scheduled with cccs and its too far away give them another call and explain the situation and see if they have any cancellations any sooner, theyre very good , helpful and understanding.

youre in the right place, so well done in facing up to it and getting it sorted

some others will be along soon to offer more pracical advice

take care, things will get better x

Morning and welcome to the forum. You have definately come to the right place.

Being in debt is a stress especially when you are at the beginning of your journey and have people chasing etc. I think if you start a DMP and are making a concerted effort to pay them back however small the payments will be it is unlikely anything will happen with regards to how you got the credit cards.

I really good start on this board is to post your SOA (statement of affairs) this basically lists all your incomings, outgoings and your debts with their APR. Here is a link to a SOA calculator from which you can then copy a code to paste your details on here www.makesenseofcards.com/soacalc.html

Once this is up on the board you hopefully will get lots of advice on how you can make some savings.

    Good luck.
