Still waiting for RBS sols to contact me with regards to charging order, I have spoken with them again today to see if they will look at a DMP or IVA and was advised that the only option is a CO, confused what to do thought about going BR due to the stress etc of all of this, not sure that our circmstances are going to change due to ill health, we were advised by CCCS that judge may not let us go BR as we have a shortfall every month of over £500, I booked appt with court for Monday but cancelled as we do not have the fees what should I do.

Err a £500 shortfall is a lot, so even going BR wont be the answer to your problem, can you expand on your post with some more details,I&E ect see if we can help advise in any way.

I think you need to re-look at all your previous posts and replies, just so that no-one ends up repeating again. I say that as there doesn't seem to be anything in your latest post that suggests anything has really changed - except the cancelled appointment, which is fair enough. If you don;t have the money, then you don't have it.
You have to let go of something. You cannot have it all with your current circumstances and that depends on whether or not you have a £500 deficit or not. How is your OH at the moment? I do hope he is feeling a bit better and not doing anything daft again.0 -

Hi thanks for all your comments my o/h is still the same however the neurologist as found a problem at the back of the eye causing very bad migraines on treatment so should hopefully sort it, other problemwith stomach will be with him for life so will just have to live with this, so nothing as changed from my last I&E apart from my income seems to beg getting less each month, so quite at work and bonus reduced, mortgage gone up to £825 from 01st Sept spoken with CCCS we are not able to cut back very much will post another I&E for you to take a peak at0

Well after a quick scan if you let go of the house and could rent for £650, im guessing the council tax for a smaller property would be cheaper and you should see fuel bills reduce.
Lose sky and go on freesat, one of £20 payment no subscription.
If you go BR the contracts on your mobiles can be ended by your OR so dont worry about contracts on that score.
I can see how you can manage, i can just about ballence your budget if you give up the house, but it will mean sacraficeing a lot besides
Its hard to face such a lifestyle change, trust me i know how it feels, from 30k+ to benefits is hard to deal with.
A CO is only going to make everything worse, as you cant cover it so i cant see you have a choice though

hi hopefully oh will return to work on Monday even though still not well, but its how long he can stay at work, did not really want to lose the house we done a lot to him and the house has been in the family for some time, once his back at work and everything should be ok just did not know what to do about the RBS going BR or let them go ahead with the charging order0

Ok where are you with RBS?, have they already got a CCJ?
What differance will it make to your I&E once OH is back at work

No CCj or court action yet, OH returning not well but I think he needs to return to work for financial and sanity part of his illness is not cureable but treatable, not life threatening consultant says that there is no reason why he cann't have a normal life as possible, other problems severe migraines on treatment to reduce blood vessells so hopefully this will work and all should be ok when he goes back to work then we will be much better off and be able to live without to much worry0

to get a charging order RBS need first a CCJ, then an interim order, that gets upped to a full CO, you have the right ti attend court to argue you are paying, however little you do pay.
the CO puts RBS at the back of the queue for payments should your house get repo's, it could take 9 months easily.
dont be rushed into anything.
and if you dont want to keep the house, and BR is looking good, stop paying all debts now, and save the money towards fees, rent, deposits, etc.0 -
Just to add to Max's post, RBS have to get CCJ for 'payment forthwith' for them to automatically be able to get a CO, if you submit details of your I&E to the judge he may well agree to installments, which won't result in a Co unless you default on the payments.Accept your past without regret, handle your present with confidence and face your future without fear0
