in the summer of 2005 i employed the services of a company called brunel franklin & co to handle my missold endowment policy by co-op bank ,i received a few letters from them requesting information which was duly sent ,and i recd a few letters back advising that the claim was ongoing .approx 18 months later i recd a letter from them advsing that the company was being taken over by cph financial services who would be dealing with my claims-i had 2 ongoing claims .i have recd numerous letters from cph and last week recd letter telling me that the ombudsman had rejected my claim against norwich union .i then wrote and asked them state of play with my claim against scottish equitable which i was sold through co-op bank-today i recd a letter telling me that brunel franklin had closed the case late 2005 but had retained no copies of any correspondence from or to themselves about my case ,but that due to length of time since closing the case there is nothing i can do ,please could someone let me know if i can now do anything regarding this as not sure who i now need to appeal to .i would appreciate any help regarding this many thanks.

Your post is a little hard to follow and your title is misleading as there doesnt seem to be anything to do with an IFA here but as I read it.....
you employed a claims handler (Brunel Franklin) to put in a complaint about an endomwent sold by Co-op. However, Brunel didnt handle your complaint but CPH Financial Advisory Services (another complaints handler) took over the complaint.
The FOS have rejected the case on the NU policy but you didnt hear about the Scot Eq policy. After checking Brunel Franklin confirmed they closed that case in 2005 but they have no documentation to verify anything.
You want to know if you can complain on that Scot Eq case from 2005?
If that is the case, then no you cannot. You have 6 months from when the insurer rejects your complaint to take it to the FOS. After 6 months you lose the right for the FOS to review that complaint unless there is a genuine and valid reason why you didnt follow it up (such as being in hospital and incapacitated). As you used a claims company (who are notorious for going to the FOS even when you dont stand a chance of winning), it is unlikely you will have any grounds for it to be re-opened.
To be fair to Brunel Franklin, they dont tend to recommend going to the FOS when its clear that you dont have a case. They will close the claim if the justification stacks up.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0
