ive got a payment plan with lowell and its down to £900 i think.
Every couple of months i get a !!!!!! call at 8am from some !!!! with an attitude telling me that I havent paid this months payment of £54 and that i now owe the full amount.
they are incompetent to say the least. they rang me once on the 25th saying i hadnt paid my payment and I polity pointed out that my payment wasnt due until the 28th of that month. Well done!
I changed bank about a year ago and changed bank account and becuase i did nit want to get behind while my account was set up I phoned lowell and advised them to stop the current payment and i would pay 2 months in advance and give them the direct debit details from then on.
Lowell started taking the standing order which was fine and the other thing they did not tell me was they were chargeing my debit card every month aswell! so they unlawfully took double the payment. I advised the bank and cancelled it but that was fine cos the debt came down quicker so left it as it was.
This month They said that their systems were confused about my standing order and the system couldnt take the money and I now owed the £900 again.
I gave them £54 over the phone and new direct debit details and guess what 30th of that month i get a call demanding i pay £900 because my direct debit failed.
Phoned the bank and they hadnt received the mandate.
We will see now if they can get it right this month.
Ive spoken to a few there and they have been ok but some are complete wasters who couldnt arrange a !!!! up in a brewery.0 -

Believe me, we make tens of millions a year, nobody is in the slightest bit concerned. I also know several bloody good people with families who have lost their jobs because a slip of the tongue fell foul of a legislative technicality, believe me OFT guidlines are taken very seriously.
Read this post back, this person KNOWS they owe the money, they know they do, and whats you peoples advice, anything but pay it back, ask for credit agreements, demand this, demand that.
How can anyone forget a 6 grand loan. Dont talk such rubbish. You spent pay it back. And your offered a 50% settlment and thats somehow taken as an insult or a trick?!? Its genuine, your speaking on a recorded phone call to which you have access via a data access request so if your told its a settlment its a settlment, and not all of us get to write of 50% of our debts. Often wonder why i dont just ignore all mine for a few years and see what i can get away with. But there again, i have some responsibilty for my actions, oh, and shame.
Which leads me to conclude that a discount is offered because the DCA knows that what they are chasing is not enforcable in law, and something is better than nothing.
FYI information, yes I do have an axe to grind against a DCA, not Lowells but one that pursued me for a debt that was not mine, but an individual of the same name, and not even related. They got the hump because I insisted that they prove my guilt, not me prove my innocence. They would not own up to the fact that they had 'fished' (something they should not do). Finally when I needed to get a mortgage I had to engage a solicitor to force them to lift the ficticious 'default' from my file, something they were more than anxious to do once they realised that by not doing so would cost them dearly.
Which just proves that the British justice system is the finest in the world............if you can afford it.
I have nothing against you as an individual, nor even perhaps the DCA's themselves, but I do have big issues with lenders that do not manage their business in the best interest of their shareholders. Again why the hell are they selling an enforceable debt for (say) 10% of its value?[strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j

FYI - contacting people at 8am could be interpreted as harrassment and a criminal offence under the Administration of Justice Act.
Furhtermore any offers of full and final settlement must be made by a third person to make it legally binding otherwise the company could come back for more as you have not given due consideration. the law dates back to the 1600s. Get someone else to write the cheque but i would negotiate for a better deal.0 -
<snip>. When it comes to standing orders they DO mess up our system because its a 30 year old system and not desgined to work in sync with a modern computer system,Other way round. The progrqm is out of sync with handling SO's
Always the way so called IT pro's doing what they are good at, rather than delivering the system the end user asked for:rolleyes:[strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j

ignore them - dont pay! they are pond life and if they already defaulted you then best to negotiate removal of default for settlement. RED have no powers to do anything so don't worry....
Have a read here to see the law, in context: http://forums.moneysavingexpert.com/showthread.html?t=1837507
My last post is actually a letter to Lowell and you'll see in this I tell them to tell RED to get lost, in so many words......
Good Luck.2010 - year of the troll

Hmm, Red tried getting lots of details out of me (email address, phone number) but I refused ot give either saying if there was a problem they could deal by post. I also refused to give them my debit card number (only giving them sort code and account number to set up a DD) so they ain't taking more money off me than I say. And if they do, then I'm sure I can phone up 15 times a day and harass them for two weeks.** Total debt: £6950.82 ± May NSDs 1/10 **** Fat Bum Shrinking: -7/56lbs **
**SPC 2012 #1498 -£152 and 1499 ***
I do it all because I'm scared.

Hi,
Can somebody please help, i have recevied two letters from lowell group for old debts which have been cleared. One for t-mobile and the other for Capital One.
I rang Lowell about them but they just keep saying their records dont show any signs of payment. i really dont know what to do? THey asked me to a small payment toward the debts and they could then put my accounts on hold, should i pay it to hold the accounts,
Please can anyone advise me, i have looked on the internet and everyone has something bad to say about them.
