please help, im at my witts end...

i entered into a DMP with CCCS over a year ago...all has been going to plan until about 6 weeks ago..Lloyds TSB decided in their wisdom to take my full loan repayment out of my O/D Lloyds account... making my O/D go back to state it was origanally and then to boot..they removed the agreed O/D limit... ive phoned them to sort it..but all i get is threats of Court and more charges... they are now charging me £15 per month for unplanned O/D and £20 a day transaction charges...
I even sent a formal letter of complaint as i was given wrong information..they said they would talk to CCCS via phone as i have mental health problems... they dont deal with 3rd party over the phone so this was a blatent lie... CCCs say Lloyds are one of the worst to deal with and always fob you off on the phone... ive asked for my phone number to be removed and all comunication to be by letter...
i have written countless letters explaining im in a DMP and im paying what i owe...now this morning ive recieved a letter..it says they are sending a collector round to my house /place of work to collect my bank card and cheque book.... obviously i dont have any of the above as i cant use the account... i cut the card up and burnt the cheque book.... to stop the collector happening i have to ring them.... im at my witts end... when i call them im suicidal at the end of the call...i have no way to pay more but they just dont care.... should i ring CCCS and tell them about this letter? my head is in pieces..... can someone please help me??? I cant take much more of this...if all the other creditors start this action i wont be able to cope....
is this just a scare tactic.... how can companies be allowed to get away with ploys like this..Lloyds TSB are aware of my mental health problems...
please someone..give me some advice....

Sorry to hear that you are having such problems.
I'm sure someone with more expereince will be along in a moment, but I didn't want to read and run - for the meantime I would call CCCS and ask them about this most recent letter and what they advise.

Please call CCCS urgently. If you have had enough, also ring Samaritans as well.
When you are feeling ready, come back and we can help you write a letter to LLoyds and to start he recalim on your bank charges etc.If you've have not made a mistake, you've made nothing0 -
I'm so sorry to hear you are having these problems, and to me it does sound lik scare tactics. I would certainly advise talking to the CCCS and not getting in touch with Lloyds, to them you are just a Debtor and they will not even consider your Health problems when they speak on the phone as the operator most likely wont even see that information.
I am in a similar situation with HSBC at the moment, and they are the only people that refuse to accept my DMP. They refuse to cancel my Loan Payment so it debits my account and bounces and they charge me for the pleasure each month. I have always tried to think of the overdraft as another outstanding loan and I just make my fixed CCCS payments to it each month as part of my DMP. Yes it does keep going up, but ultimately I am waiting for them to defaulted so I can finally get a fixed amount of debt.
You just need to remember, you are making monthly repayments for each of your Debts via CCCS, you are doing as much as you can possibly do. Make sure you keep coming on here for support :A0 -
Ive called CCCs... and they say it is a standard letter...
they said to give Lloyds another couple of week to respond to my formal complaint.. but they dont really expect anyone to come knocking at my door..and they said if someone should call..just tell them to go away as they have no rights to enter my property...
i am so stressed out.... im calmer now having spoken to CCCS... they pointed me in the direction Martin's wonderful website to claim back the charges... so all advice would be greatfully received...

Glad you are feeling a bit calmer.
A few things to think about.
1. Do you have Payment Protection Insurance on either the loan or the account? Is either paying out if you do have it.
2. You can reclaim these charges so head over the the reclim you bank charges section.
3. if it would make you feel more comforatbel, pen a short note to Lloyds in reponse to theor letter telling them what you told us in you first e-mail regarding the card and cheque book and remind them that you have not sued the account since...
4. I am hoping that you have another bank account set up into which your money is going now? have you cacelled all the DDs abd SOs on the old account?If you've have not made a mistake, you've made nothing0 -
We on the forum always advise changing your bank account to a BANK with no connection to your debt . This has happened so many times , people have trouble with a loan or a credit card , the bank then take money from a currant account . Anyone reading this thread beware !0

the only D/D set up on the lloyds account is that for the lloyds loan..as they refused to accept a payment direct from CCCS... i guess this is so they can just take what they like when they like!!!!the B****rds!!!
in response to Stapeley...Halifax is my safe account...not so safe now it seems!!!! CCCS have said to leave it for the moment as the 2 banks may keep seperate licences* (spelling isnt a strong point sorry!)..
Im proud of myself for not crying today.. its the first day in a long while i havent cried.. i just wish i could stop panicking.. im doing my best to get out of this miserable situation.. 5 yrs 8 months to go!!!0 -

Very similar to me with HSBC as the refuse to cancel the payment. I just ignore that as its out of my control so it just debits my current account then they bounce it. I still make the monthly CCCS payments to HSBC and don't care that they haven't accepted it, its all they are going to get out of me!0
