  • I would be tempted to print out the email that shows they agreed, then send that with a strong covering complaint letter, further explaining the offer you are making. I am not a huge fan of emailing important stuff like this to be honest as so many places the email just goes to a team to deal with so you might have a different person each time. If they are anything like HSBC they have a dedicated complaints and customer service team that then have to look into the complaint and respond to you directly.

Under normal circumstances I would agree with you. I have been dealing with the Customer Services Manager !!!!!!!!  .

    Now that's really frightening.

Any ideas who else I can send a complaint to, am thinking about OFT or Trading Standards but I read somewhere recently that they need a large amount of complaints before they act on it ?

  • I would seriously be writing to them and asking for their cpmplaints procedure (email the same person) They have to give you that! Then follow the guides..

I would also contact trading standards for their advice! OFT will only get involved once you have made a complaint to MBNA and left it a month or so.. :(

There is someone higher than the person you been dealing with!

I would also print all email corrospondance out (include headers) and send along with letter of complaint! You'r best bet of action. :)
  • It may be worth waiting until they do pass it to a DCA - to be honest, that's what I'm waiting for. You may be able to get a better settlement figure.

I'm afraid I don't have a lot of confidence in TS or OFT - not sure they do ever investigate complaints but that's just me being negative! I would be inclined to write to someone senior at MBNA and see what happens.
Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)
  • Many thanks to everyone who offered kind words and brilliant advice. :D

I did email PayPlan in the hope of getting some sound advice too, but have not received a reply yet. Maybe its worth hanging on and waiting for that prior to sending any letter of complaint.

Just as a matter of interest, by accepting my offer, would they also be accepting my terms too (full and final)? Just a thought.

  • hi babbit,

just wanted to say weirdly i am now in almost the same position with mbna full and final all agreed over the phone but explained that i wouldn't pay to i have it in writing. Two letters sent by MBNA one to cccs and one to me saying this, neither of us recieved it! mbna rang again (last thursday) to see if i accepted offer, explained i was waiting for f&f letter first and they have said they will send it again. Although the bloke who rang said they were not allowed to mark it as f&f but partial and thats what letter would say, i did say that i had already agreed f&f but he wouldn't have it! grr!! so i await the new letter! by the way what % did they agree to?if you dont mind me asking?they agreed 40% to me, which i thought was pretty good as i hadn't asked them, they asked me!

    Hi Pinkie.

IDENTICAL - although mine was via email ! What a bunch of muppets.
I am cross now as my F&F was 50%  . If they don't send the correct paperwork then they can go hang, and they'll be lucky to get bloomin 10%.

  • whoops sorry didn't mean to upset you. My 40% is worth nothing until that letter appears thou!least you have an email!well i will keep you posted if i here anything, but i wont hold my breath!Just a thought if they do send the f&f with the 40% you could always use my case as a bargaining tool for yourself!?
