fraudulent secured loan?

Hi there

I recently received a letter from a loan company addressed to my ex-wife (who has not lived at my house for more than 15 years), stating "... I can see that we helped you arrange a loan last year for £60,000" and essentially inviting her to apply for another loan. Can this be serious? We have been divorced for many years and she received a legal settlement figure for her share of the house. In addition, I know her income would in no way allow her to finance such a loan. Have just checked my Experian credit report in full and I am squeaky clean!! Surely there is no way in hell that she (or someone acting as her) could have obtained what I take to be a secured loan against my house? Any advice on this would be welcome.

  • Do you have a mortgage / is it in your own name - are the deeds to your property in your own name?

    My mortgage, which was in joint names, was paid off about 5 years ago and I have the deeds; however, I must admit that although I paid the financial settlement as stipulated by the divorce court as settlement for her share of the property, I somehow never got round to getting her name off the title deeds; I was quoted figures around £500 from solicitors to do this and at the time, I baulked at doing something I felt was unnecessary, since our divorce was totally amicable and we are still on reasonably friendly terms.

    Do a £3 search at the Land Registry on your jointly owned property.

  • You say that you have the deeds but do you have the Land registry document or pre - registration documents?

    Not sure what these documents are; all I know at present is that when I paid off the mortgage several years ago, the bank sent me an envelope containing lots of documents including the deeds; I am going to look through these just now to check.
    Incidentally, I didn't even bother to get the standard security discharged!
    Also, I am in Scotland so might it be possible that the a different type of documentation is used?
