Hi
i'm new here but have just recieved a letter from lowell finanical.
its for an old debt, which lowell portfollio brought bur is using lowell financial as the debt collector, i,m sending a cca s78, but who do i send a record delivery to to
lowell portfolio 1 or lowell financial
lowell financial uses a PO BOX which will make it hard to prove the 12 day as they will not have signed for it, but for the whole bunch collected at once on a seperate form.
but lowell porfolio has a registered house address, if i send it there then it will be signed for.
do i send to both address ?????
advice please
thank you

If you have not paid this debt at any time in the last 6 years, it is likely to be statute barred and therefore unenforceable. If you've have not made a mistake, you've made nothing0

thanks
i have sent a cca with a pound to lowell finance at both address, po box and the registered address. lets see them wriggle out of this one.
as for being statute barred, pass.. cant remeber how long ago, but must be very close or over 6 years0 -
OK
If they come back with any document, post up on here as a lot of what is sent by DCAs as CCAs are nothing of the sort.If you've have not made a mistake, you've made nothing0 -
Recieved a letter with 1 of the postal orders, i even sent them an email with a copy of 1 of the letters telling them to expect the recorded deleivery letters, saying there will be no way they can deny not recieving the cca request.
like i said i recieved a reply from them today, oh how polite the letter was..lol
all it stated that they acknoledge my letter and they have 12 days +30 days to supply my request so they have said they got 42 days before they cannot enforce in the debt.
hogwash
after 12 +2 days they will recieve a 12+2 day default notice, but i understand now that it is not a crimmal offence after 30 days as that section has been removed in may 2008 ( shame).. but they cannot enforce the debt.
i will keep the forum updated, as with this credit crunch alot of peeps are going to find it hard and its okay we bail the ruddy banks out when they get it wrong , but they are quick enough to hound us when we get it wrong.0
