what about just taking them back and saying they are broken and therefore inside consumer act due your money back... (they are kinda broken in that they are poo)
Why can't OP just accept the fact that he or she has brought the wrong ones and it's no fault of the shop?

If you want to get rid of them, try taking them to anotherhmv and say they were as a birthday present(if paid by cash) or you ask for a refund(if paid by card)0

I think because they're opened and there's nothing specifically wrong with them, they won't take them back as they can't resell them.

I'm going to print off the page of the sale of goods act that says they must refund if its not fit for purpose, and ask them (probably get a manager) to show where in the law it says they can refuse on grounds of them being worn.
Unless anyone else knows something I don't?
Would a shop refund swimwear that you had worn just because it didn't stay put when jogging baywatch style along the beach? When you should have bought a sensible speedo costume?
Or a ballgown that you tripped over if you fell over drunk ,chav-style at Ascot?
Neither those items are SUITABLE for those activities.
Neither were your earphones.

Unfortunately, I didn't ask at all. Just went to the headphone section, picked them up and paid.
And couldn't you argue that headphones are for listening on the move, which these aren't really?
From someone who used to do a LOT of running, then you need to select earphones that are specifically designed for running, and they usually say so on the packet!
If they didn't say that they were for running, then you won't be able to get a refund, as you can't claim they're not fit for purpose. "On the move" would mean commuting/travel, walking round etc...Should've = Should HAVE (not 'of')
