Cca request/Marlin DCA/ First direct logistics

hi all,
my sainsury cc went over to marlin dca january this yr. they kindly added charges and interest of £1500 to our balance. i requested a CCA and in february, i had a letter from marlin to say they didnt have one on file (suprise surprise) but will send it when they have it.......
i didnt hear anything until last week, which marlin wrote to me demanding the money, or a repayment plan. i didnt beckon to ringing them, and sent a recorded letter, stating i requested the cca in january, and as its past 28 days they have made a criminal offence. i havent heard from anyone yet regarding my letter, but arrived home and had a card from first direct logistics, im not expecting a parcel, ive rang them and havent gave my phone number. but googling it, ive found its some DCA. i didnt think they can sell debt on???? what should i do now. we havent any extra money as we have mortgage arrears to address first. im disputing that my original debt is £3100 and its now £4600. im not gonna pay this extra no way. i dont want to also appear ive got my head up my arris either......

    If a debt is in dispute, it can't be passed on to a 3rd party. Did you contact TS or OFT to report Marlin?

    hi george,
    i filed all letters from marlin and waited for them to send the cca, a lots happened to me and hubby since feb(wheres the time gone) and havent chased them to see whats happening. when i received last weeks letter, i sent the formal complaint letter, the one on your posting. im assuming that the card ive had today is to do with marlin?? or they have passed it to someone else.... cant see a link between marlin and the first direct peeps on google?
    ive just reported the first direct logistics to TS, and i got given financial ombudsman number. im not disputing the debt exists gosh no, but i cant have them adding on £1500 to my debt, and want to come to an agreement with these people, but they aint people you can talk freely to are they? they after all wanted us to pay min £600 p.m. we are struggling to find the extra £300 for our mortgage arrears as it is. using my tax credit and child benefit for that at the mo.

    the debt was in dispute as of the end of Feb so Marlin are breaking the Law by either pursuing it or by moving it on to another.

    If its 1st Credit chasing it, e-mail or registered post them telling them this and request a written response, dont talk to tem on the phone and DONT sign anything....not even your own letters.

    Send that letter to first direct. It seems that Marlin have either sold the debt on or got them to act on their behalf. 1st direct may not know that a CCA has been requested and that the account is currently in dispute so best to send them a letter in the first instance.

    As for Marlin, what letters did you send?
    Original CCA request?
    letter after 12+2 working days?
    letter after 12+2+30 days?

    You don't need to send the last 2. These just make it clear to them that you know your rights and remind them of their obligations.
