well we had our charging order & redetermination hearing today and....

it didn't go very well i am afraid to say. 
i am sure quite alot of you followed my original thread, but i cant seem to find it now and wanted to let you know the outcome. sorry it isnt any good news!
From the moment we went in the judge wasnt very nice, she really didnt listen to our reasons and didnt think any of them were a valid reason to not apply the co. she didnt even bother to give us a redetermination hearing!:eek: which i pointed out at the end, to which she said there was no paperwork for this:eek: so i am glad i have been really anal and docmented everything i have in a file (and took that file with me!) as i showed her our letter and the courts letters canceling the original appointment.
on the upside she did agree however the original order for £400ish was way too much and the amount we have been paying £125ish was more realistic so she changed the co to this amount per month.
more than peeved off as if she agreed that the amount on original ccj was too much and that the amount we are paying is correct why the hell do we have a co?
if the redetermination hearing hadnt been cancelled back in may by the courts then we would have probably not ended up with co, as the amount would have been set in stone then, we have kept up to date with these payments and that would have been it.

sorry to hear your news thepinkladez....sometimes i think these judges have absolutley no idea about the real world at all and have preconceived ideas before they even walk into the court room....hope things work out okay and try not to let it get you down...0

think your right tbh.
just feel like crying as we are trying so hard and just keep getting kicked in the teeth.
fixed mortgage is up in feb and seems like kensington cant offer any offers at the moment so it will rise to 9% so we will be paying nearly 1/2 again on what we are paying and cant see how we will get ayone else to give us a mortgage now we have a co on our home. wish we had just br ourselves now as dont know what we are going to do.
sorry i am so miserable but i really feel there is no point at the moment.

sorry just realised how miserable i sounded earlier! well i have had a big cry and now i do feel quite a lot better. on the upside i got my new job and i have realised i should earn more pcm than i thought as my salary is 11,577 so thats more than the £600 pcm i thought i would be getting, i think!!0

Sorry to hear about it pinkladz. I have been following your original thread.
Sometimes I think the judges have no idea of the law - bit worrying really.

cant be any practical help, but can add my support,
It seems sometimes that some of these Judges ( god knows what qualifications they have......failed Solicitor/ rubbish Barrister ) just cant be bothered to actually think about their decisions.

thanx lilac well £800 is still better than the £600 i thought!
plus think i should get a bit more as havent earnt very much this year maybe about a grand so well below my tax freshhold so tax wont kick in for a bit!think thats how it work anyway!0 -

hi fermi , yes if you can merge them it would be great useful for people who followed the original thread. interesting article also, makes me feel very uneasy but its a fact i have to be aware of. on the upside judge did say sale of house was very rare and not really suitable in our case so lets hope egg will not even try!and if they do we get this judge again!0
