    Glad you finally got in to it. Getting responses on that site is a bit slower than here, but they really know their stuff. Just make sure the subject heading is relevent to the query and you should get more people looking at it.

    Let us know what they say.
    Good luck.

    It's easy to give in to that negative voice that chants "cant do it" BUT we lift each other up.
    We dont count all the runners ahead of us & feel intimidated.
    Instead we look back proudly at our journey, our personal struggle & determination & remember that there are those that never even attempt to reach the starting line.
  • I've opened 3 new basic bank accounts. One for Bills, Wages, Food...

    My wife has put in an application for DLA, I have been reading through the site and found some useful information that I will be putting into action.

    Will keep you guys updated.

    Many many thanks for all your advice.
  • Having 2 accounts has worked extremely well for me....
    I opened a Natwest Step account and have a set amount transferred into it every month, that's my spending account!No overdraft, no cheques, just money to spend guilt free that's mine.

    Hi everyone not been on much as both kids have the virus really bad and my wife's not been well either.

    More stress because our Mortgage is with Halifax and we're worried about how the take over would affect us especially since we owe the most to Lloyds...

    I've found some useful letters and sent off for the CCA. I received one called a Credit Card Agreement? Is it the same as the Consumer Credit Agreement?

    I actually got some replies from Consumer Forum which I am reading through now.

    With regards to the bank accounts, I have transferred all the direct debits across and given my work my new details. It will take some getting use to having no overdraft or credit cards but I guess I've got to make it work.

    If the agreements for credit were before 6th April 2007, they need to have the prescribed terms on them to be legally enforcable. Check to make sure this agreement has the terms required.

  • Hi everyone.

    Been getting advice from Consumer Forum (great bunch) and dealing with threats etc from Bank Smart and everyone else.

    I have managed to cut down so we now have an extra 100 quid so I've gone back to Pay Plan in the hopes that they can get some interest frozen or get those people off our backs...

    I've sent of for CCA and Natwest & Virgin have replied but Capital One, MBNA, Natwest Bank are yet to reply.

    With the above mentione 2 supply Credit Card Agreement whats my next course of action? Also is a Credit Card Agreement the same as a Consumer Credit Agreement?

    Have a look at my post above - there is a link that shows what must be in a CCA for it to be enforcable. If any of the prescribed terms are not included in the agreement then it may not be enforcable.

    For the credit card, it should state:
    B Repayments
    A term stating how the debtor is to discharge his obligations under the agreement to make the repayments, which may be expressed by reference to a combination of any of the following-
    (a) Number of repayments;
    (b) Amount of repayments;
    (c) Frequency and timing of repayments;
    (d) Dates of repayments;
    (e) The manner in which any of the above may be determined; or in any other way, and any power of the creditor to vary what is payable.

    C Rate of interest
    A term stating the rate of interest to be applied to the credit issued under the agreement

    D Credit limit
    This may be a term or the manner in which it will be determined or that there is no credit limit.
