Starting the process - first post

Hi All,
I am nervous/scared but I have been thinking a while and now feel I have no option but to go BR. All the debt is mine, I have no assets as rent from a Housing Association. My husband is a self employed mortgage broker and has not has any money in for 2 months and is now looking for a paid job and has pretty given up on mortgages as there is no work out there. At the moment he is not working and it does not look likely for a few months as so hard trying to get out of that industry.
My questions are as follows;
1/ We have 2 children and my income is 1720 PM, 130 CB and Disability Living Allowance 250 pm for my son who has Aspergers Syndrome. Our outgoings are 2050 PM and my Unsecured Debt is 55,000, we were just keeping our heads above water as my husband contributed but now he is not I have got to the stage where I have had to cancel DD's so we can live. Do you think I could go ahead?
2/ My Husband had bad credit and no Bank Account so until 2 months (the last £400 he got) ago his wages were going into my account - will this stand against me?
3/ I am going BR by myself as all the debts are mine and run back over past 7 years started when husband and I split up and then yes we got back together 2 1/2 years ago.
4/ Will CB and DLA count on my I&E?
5/ If my Husband gets a job most his wages will have to pay for Childminder for kids and he has other bills he would be able to contribute about £300 pm would that be ok?
6/ As my son has Aspergers I have mobile phone contract for me and him as he gets train to secondary school 7 miles away and only 12 - would I be allowed keep it? We also have a £450 car which I need to get my 9 yr old to get to school and take older son to rugby on saturdays - sometimes matches are miles away, could I lose it?

Welcome along Honey.
I know how scary it all is...especially cancelling the DDRs!!!...& whether its just me but Sunday nights seem the worst as that dread of what the next working day will bring is daunting.
Anyway....you have done so well to post & somehow getting it all down in writing is a great first step & makes you feel as though YOU are in control & that is very positive.
So first step is to call one of the debt charities (see top toolbar) CCCS need appt but Nat Debtline can chat straight away. If you prefer face to face then pop into your local CAB & get an initial meeting. You need to get informed advice as you cannot `just go BR` as the judge/court will need to know that you have had recognised advice.
Your OH will be having tough time as the mtge industry is on its knees at the moment so good luck to him on the job front.

4/ Will CB and DLA count on my I&E?CB no but not 100% on the DLA
5/ If my Husband gets a job most his wages will have to pay for Childminder for kids and he has other bills he would be able to contribute about £300 pm would that be ok?yes you only put down what your OH contributes not his income on your i&e
6/ As my son has Aspergers I have mobile phone contract for me and him as he gets train to secondary school 7 miles away and only 12 - would I be allowed keep it? Yes but excess over what the OR allows may have to come out of your surplus. If you want to get rid of that contract miss som payments and iclude it in your bc.We also have a £450 car which I need to get my 9 yr old to get to school and take older son to rugby on saturdays - sometimes matches are miles away, could I lose it?You would need to fight your corner for it. If you need it for work all the better

Hope it goes well tomorrow with NDL. As with all the charities at the moment they are extremly busy so be patient and just sit with your finger on the redial button.
