Dealing with Creditors in the interim period before and after Bankruptcy being grante

Yes, once I get the award (seems strange for Bankruptcy to be seen as an award) I will photocopy it and send it recorded delivery to all my creditors and if I'm still getting hassle after a month of sending it I will contact the AIB. Btw I do like what your ex said to the DCA....I would like to say something like that too...but the last 6weeks has zapped my confidence/assertiveness that I'd probably burst into tears half way through the sentence!

    You say that now but when the deed is done and you get your AWARD!!! they cant do anything to you and you will get more confident in your approach to these people.

    I still get one letter every week without fail threatening me with court/baliffs ect from one DCA, I just open it, say "Eff em" and shove it in my Bankruptcy folder. Its costing them money to process it, if they cant communicate its there problem, I am under no obligation to deal with them now.

  • 1st of July I went to court. My case is obviously different to yours but I had not paid a creditor for nearly 18 months and all I was getting were the red letters from some of the DCA. And I wasnt overly worried about it because I have illness problems that kinda took a priority over the debt (48k). I went bankrupt because a) I had the funds to do it, b) I have no assetts c)It was one less thing to worry about, and now I can concentrate on getting better.

    I can tell you this much the help on this site was a godsend and made the whole process smoother than It would have been without MSE.

    a telephone with caller display is worth its weight in bakelite.

    I do not answer any incoming call that does not display a number , or any from exchanges I am not expecting to hear from.....or that come up as INTL....despite my levels of debt [and CCCS recommending bankruptcy]...I am down to roughly two calls a week...all when I am out.

    This may rise as some debts are sold onwards.......however, they all have recieved my list of creditors...so know the likleyhood of getting any beans out of me is remote.....I do wonder why companies purchase debts which patently will yield zero.....??

  • Because they probably buy your debt for a quid, so if you only cough up 40 quid its a fair old markup on the initial outlay, plus they probably buy in bulk and just automate the letters. I suppose if only 10% of people pay up something they are making money, well they must be making money otherwise they wouldnt do it.

    I have read on the DFW board that some banks have there own DCAs with different names and run as independant companies but exist in the same buildings as the bank themself.

Exactly, that is the most important thing and I hope losing the stress and worry of debt is helping your recovery progress easier

    Like others have said, I think you might be surprised how much stronger you feel once all of the agonising, and decision-making, and uncertainty is over. Once you have the award, and know exactly where you stand, and know that your creditors shouldn't be calling you, or writing to you, you might well find that your confidence comes back in leaps and bounds. :T

    Six months ago, I couldn't have imagined ex-OH having the confidence or the strength to say anything like that to a DCA. He's like a new person nowadays. Cliche, I know, but true.

    I hope that things go well for you, and that you rediscover your confidence and assertiveness. They're probably just a bit buried under all the worry rigthnow :A .

    Glad to hear your friend is OK & that you are finding the strength to deal with your own situation.

    As regards your creditors just be polite & tell them you will only communicate in writing & this should give you some time. Insist that they remove your work telephone from their records..even give them a mobile number where at least you can see caller display so can choose whether to answer or not.

    For some of my creditors (MBNA!!!) I have given them a PAYG number (one of those O2 freebies)...but oh dear I have`nt put it in a phone yet...how absent minded of me!!!!

  • Thanks so much Coolcait and SSA for your kind replies:T Yeah, I'm sure I will return to my normal positive, optimistic self once all this bit is over. Lol@ PAYG...I bet they love you!! Everyone's nice replies have made me feel that I can cope with this a bit better than I thought yesterday....as BAAB and I think Shadow said.....what can they really do once I'm 'awarded' bankruptcy and how long will they want to flog a dead horse;)
