Redundancy

Hello, hope someone can help with this.

I will soon be made redundant and have been given my redundancy package.

Do you acrue holidays, that is 2.5 days a month, when on 12 weeks lui of notice. I will not be working the 12 weeks but will pay tax and insurance.

  • If you are being paid in lieu of notice then that means you are being paid in place of receiving notice.

    If you received notice, then the clock would still be running and you would accrue holiday.

    As you do not receive notice, the clock has stopped and you do not accrue holiday.

    If you are paying NI then I suspect that you are not being paid in lieu of notice. What seems to be happening is that you have received notice but will not be required to work it. On that basis, you should be entitled to holiday for that period.
  • the union and management had came to an agreement that on the last day we worked at the site,then i would be paid my 12 weeks lieu of notice,but i think why we are paying tax and ni insurance on it is because the lieu of notice has become contractual,also because it is not an ex gratia payment ,i think that is why it is not tax free,so i have done a bit of digging on the net,and i think we should accrue holidays for not working lieu of notice.Also the company have worked out my final settlement up untill the end of my lieu of notice.
