In 2007 my wife received letters from debt recovery companies for money owed on accounts openend fraudulently at her previous address. We dealt with all these and Buchanan Clark + Wells were one of them. We had letters from BCW to say they were investigating and heard nothing since.
Today (17 Months later) we have had another "FORMAL DEMAND" letter from BCW to do with another new account (which is fraudulent) ... so here we are agian with a new start!
Do i just send them a letter to say prove it.. or is there a standard template letter that we can send to them? We have a letter ready to go asking for:
*What the debt is for?
*The name of the company the debt is owed to?
*The date in which the original company started this account?
*The full name/address and date of birth of the person that opened this account with the original company?
My wife's Credit Expert account is showing a debt for the amount owed and (like all the other accounts openend fraudulently) is showing incorrect DOB and that the account being opened after the date she moved.
we don't want to start any communication on the phone as they are always such a pleasue to talk to!! So this time just want to do everything in writing.....or should we just ignore it. We know we are innocent!!!
Any advice grately appreciated.

Hi
you are fully entitled to challenge this and the burden lays squarely at the feet of the DCA to prove you owe the money.
You can simply ask that they provide you with evidence of the debt
a basic letter that is used to great success on the CAG is this oneDear Sir/Madam
You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.
I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).
I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.
I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.
I/we look forward to your reply.
Yours faithfully
Amend it to suit, either I or WE but not both obviously
Regards
