Scotcall, advice needed

I've just recieved a letter from Scotcall about my Yorkshire Bank Credit Card
asking to call them or Yorkshire Bank.
I'm just starting a DMP with CCCS, should I phone them and restate that I'm with CCCS or call CCCS

any help gratefully accepted

  • I had letters from Scotcall too re my Barclaycard. I would ring both Yorkshire Bank and Scotcall.
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)
  • DON'T PHONE SCOTCALL.

    I do suggest though that you call YB and get it confirmed that they're passing the account on. Demand for that to be sent to you in writing.

    If YB confirm (in writing) that they've passed it on then write to SC and tell them that your'e on a DMP with CCCS, give them your client number and say in the letter that CCCS have your authority to negotiate on your behalf. Phone CCCS and tell them of the change, give them the SC ref number and they'll move your payment from YB to SC.

    If you've read the threads on this part of the forum then you'll know that their are things you can do such as write to them if SC start to harrass you on the phone and demand they stop, and of course you can always ask for a copy of the credit card agreement.

    If YB don't confirm in writing then that's against OFT debt collection guidelines. You are in your right to ignore SC until that happens. After all if you think about it anyone could write to you demanding money.

    Hi there,

    Most Yorkshire Bank credit agreements that ive come across are defective, many do not set out the statements of protection which the Consumer Credit Act 1974 requires

    It may be prudent to ask for the credit agreement using the provisions of Section 78 (1) Consumer Credit Act 1974, or in the alternative use the SAR S7 Data Protection Act 1998 to obtain the info you require

    once you have this you can look at the agreement to see if it contains the info that it should. if it doesnt then it gives you a great deal of leverage to negotiate with them,
