So Sainsbury's have found the agreement and I have sent a F+F. Waiting for a reply.
I had two letters arrive today (26th August) in response to the CCA requests, both dated 11th August (!). Identical letters save one is on New Day letterhead (who I have an account with) and one on fluid letterhead (asking for info to be sent to New Day - I have never had an account with Fluid).
Letter says:
OUR REF: XXXXX
Account Number: NA - My name
Dear Sirs
...
Upon review of our records we have been unable to locate an Aqua account for you and in order for us to proceed with your request we would require the following additional information
- Full previous address history
- Copies of any statements or account numbers held previously
Please send to {NewDay Address}.....
If we do not receive any additional information we will assume you no longer need our assistance in this matter.
[END of letter]
As I have said I have Asperger's and have great trouble with ambiguity. I have lived at the same address for 25 years, long before I opened this account, and have already supplied them with the account number (which I am paying into via Payplan).
Happy to resend these but this doesn't appear to be of any use to them BUT
- What does the last sentence mean in regards to the status of the account?
- Is it enforceable or not at the moment / in the future?
- Should I tell Payplan to resume paying?

So you did a cca on the Aqua card. They responded (parent company New Day) saying they can't locate an account.
Is that right?
No I wouldn't commence payments. Pay the enforceable debts, and if they write asking for payments, remind them that your s77-79 request has not been fulfilled.1 -

Need some help from you guys
Off on long term sick and now being made redundant. Currently in reduced payment arrangement with credit card company, a catalogue company and a DCA who took over debt from a second catalogue company. Payment arrangements are up to date. Could I start the process of F&F or is it pointless as regular payments are being made? Thanks

Two of the accounts are in Special Arrangement, paying reduced payments for 6-12 months. The other account is a DCA but there's no mention on credit file.
Have prepped letters using the template for F&F as I can get help. Unsure what to offer.

Account 1; Lowell, purchased from Jacamo after defaulting on payments. £3000 original balance, now at £1800. I reduced payment to £25 per month (from £100) a few months back. Changed that to £10 today. Interest Frozen.
Account 2; Freemans, £3000 balance and in special payment arrangement for another 4 months before review. Interest Frozen.
Account 3; Virgin Money, £6900 balance. In special payment arrangement of 1% per month. Interest Frozen.
