The debt was originally a Clydesdale Bank credit card. It has definitely been acknowledged both in writing and by token payments.
When it was with Clydesdale, a CCA request was made, and Clydesdale did send that back.
OK, then 30% isn't a bad deal but there's probably a bit of room for movement.0 -
Sent off my CCA requests on the 6th March. PRA group have replied acknowledging my request, and they have requested the information (from the original creditors I guess). In the meantime they have placed my accounts on hold and ceased any further collection until further notice.
One of the requests was sent to Moorcroft for an old Argos account. Argos have replied directly to me, and they have sent me 9 years worth of monthly statements. Im pretty sure this doesnt represent a CCA but can anyone advise? It has my name, address, balance, payment history and shows interest rate but doesn't show the T&C's. The letter that accompanied the 200 pages of statements said "Please find a copy of your statement as requested". I used the generic letter whilst requesting the CCA which PRA clearly understood, but Moorcroft/Argos didn't. Is this likely to be a tactic which could indicate they don't have the CCA?
Have they provided the correct information? Should I write back and say that they have not complied with my request?
Any advice appreciated as always.0 -
The standard letter asks for 'credit agreement along with a statement of account'. They don't have to come together so I would expect them to send the credit agreement in the next few days. You could remind them if it doesn't turn up, or just continue as you are, knowing the debt is unenforceable.0

Well our offers to PR* for a F&F were declined. I offered approx. 25% and they came back with a counter offer of 80%...don't think so. We will carry on paying them £1 a month and see how long it takes them to realise that it is going to take years to clear the debt. We have been on the DMP for 4 years now. I will try another offer in a year. Still waiting to hear back from the others.DMP 2015 £57,549, now £36,112 (37% paid)
EF £200 Mortgage OP's this year £115

Had a response from PRA to say that one of my debts with them is unenforceable. I am still waiting for a reply on the second account held by them.
So now I know this is a lower priority debt to deal with, so I will be stopping payments to them to enable me to concentrate on paying back the higher priority debts. I would like to have the account settled so will make a small offer to settle. Interestingly they refused an offer last year to settle at 40%, they countered asking for 60% but now I have done the CCA and know its unenforceable, I hope to settle for a lot less as those previous funds were swallowed up when I moved house.0 -

Hi Levie,
As I have been advised by the experts on here, have you already done a CCA request?
If not you should do this first so you know where you stand legally on the debt. Template letters are available to download from national debt online website. Send recorded delivery with a £1 postal order.0 -
Oo Dellboy And Levie; what is a CCA request please?
I’ve just sent an offer to link financial and hoping they take it; have snowballed so payments have gone from £6 a month from May 2018 to £30 now after Cabot sent me a generous f&f offer for the 3rd time that I was able to borrow money from
Friends for which I’ve already paid off. Hoping it gets accepted now, they should’ve received yesterday. How long did people have to wait for link? They got token payments 2013-2014 then while my husband left and we got divorced I forgot about thinking about debts while I was signed off work and trying to survive life as a single parent so Cabot did a CCJ, so kind and link went quiet. Thanks

Offered 20% settlement to W*sc*t and they have come back saying they will accept 30%. Whilst that is great, and I will be happy with that if I can't get any lower, I have emailed them back and asked if we could meet in the middle at 25%...I will let you know the outcome.DMP 2015 £57,549, now £36,112 (37% paid)

I've just offered Wescot 20% and they came back with 50%, i haven't sent CCA requests yet, i'm not sure whether to do that or hopefully settle at 30%
It was defaulted in October 2013 so will be coming off my credit file later this year.0
