Loan Problem
Options
Hi,
I hope somebody can help me out with a problem I have with GE Money Home Lending.
In June 2004 I took out a loan with GE money (at the time called first national tricity finance) through Safestyle UK for windows & doors etc.
Initially the loan was for £5400. In February of this year, I received a letter from GE Money stating that somebody else had been paying my monthly payments since September 2005 and that I was liable for over £3000 in missed payments. I had honestly not noticed that hey were not coming out - which I accept was bad on my case, but I just assumed that as noone was telling me that it wasnt being paid then it was being paid. I've been concentrating on the people who have been writing to me to say that there was a problem. As it stands, GE have been writing to me every few months about rate changes etc etc, so I just aautomatically assumed everything was just fine.
Included in the letter was a copy of the DD instruction which they claim was filled in and signed by me. The DD had my name on the top of it but it was not y bank, not my signature & not my writing. It was for a bank over 300 miles away from me. They have basically sent me someone elses bank details.
After contacting the bank, they advised that they were accepting no responsibilty for the error and that it was totally up to me. They also said that they had written to me to advise about the DD change. Despite me telling them that I had not received this letter - they said tough!!! They have sinced issued a default against my account which has all but obliterated my credit rating.
I'm just wondering if anyone knows where I stand with this one. I am willing to take responsibility for failing to notice that the money wasnt coming out, but surely GE Money have got some sort of responsibility to ensure that my account does not get sccrewed up by some numpty applying someone elses account details against my account and they should be held accountable for their mistake. Can I get my credit rating corrected as it was their mistake that caused the problem in the first place??
Any help would be great, they're threatening court and allsorts!!
Thanks
Ann
