I'm not sure that statement is really fair. ATOL are dealing with over 40,000 claims, something they were not really prepared for. So it's totally understandable why it is taking so long. I am also waiting for a refund and it's driving me mad waiting this long but now i've seen how many claims they are dealing with I can appreciate why it's taking so long :)

That may be but I do really have a right to be annoyed about it all. Even upto 2 weeks ago they were still saying 12 weeks after you've received your claim number, so surely they knew by that point that they had 40,000?
  • I am still awaiting my claim but I lost my accomodation whilst in Florida and had to rebook whilst abroad. What is really upsetting for me is that I booked through Travel City, Ive not yet had my refund and they are trading again through Virgin and selling holidays! It would nit be so bad if I had had my money back!!

I know it doesn't help your situation, but Travel City Direct are not trading again. Virgin Holidays bought the Travel City Direct name and brand from the administrators, and have slapped it on some of their brochures and launched a new website. It has absolutely nothing to do with old Travel City Direct apart from the name and logo.

We unfortunately, are in the claims waiting game, we were due to fly from Newcastle to Dalaman on the 13th Sept, but due to the misguidence of our travel agents we had to totally abandon our holiday. Travel Republic did not get a grip of the situation ie: should have dealt with the immediate departures.
We posted our claim to ATOL on Sunday 14th Sept, I received confirmation on the 31st October, this explained due to large volumes of claims it would take longer than normal.
I have since been contacted by the CAA claims asking for my ATOL receipt number, this was sent in the first instance, I have sent further copies of the receipt and would hope it does not take a further 15 weeks to sort the claim.

    Regards

I'm not Martin, but as far as I understand it, and from other posts in this thread, I think all claims that involve Travel Republic are on hold, as the CAA are taking Travel Republic to court over the way they sold their holidays. CAA are saying Travel Republic did not sell the holidays correctly so they are liable for refunds. Unfortunately I think this may take a long time to resolve, although I think the first court hearing is in February.

Travel Republic didn't sell their package holidays properly IMO but as I understood it the CAA were paying out those claims (possibly later than the others as they will be used to build their case) and pursuing the companies seperately so that the consumer does not lose out?
  • It will be 12 weeks tomorrow since i rec'd my claim number and have not heard anything yet, what's the best course of action to take?

Mine has passed 12 weeks, I called last week and was told it would take another 2-3 weeks
  • Was booked flight only with Travel Republic, who didn't want anything to do with my claim for compensation so passed to my Visa provider RBoS (citing section 75) who paid me compensation in full on 22 Nov. Received a letter this morning saying that I now have to make a claim to ATOL and they will be debitting the amount they credited me with in 12 weeks. Do I have to go along with this ?

I have just spoken to someone at ATOL and they said that not all Freedom Flights have been refunded yet. Also, Travel City, which is my claim, have not been refunded yet. They are dealing with claims numerically and mine is quite a high number and it will still take at least another 4 weeks!

So it looks like I'm NOT going to be able to get a discounted BA flight now as you have to book by end of Jan. I doubt very much if the refund comes through by Easter.

Who can we complain to about the disgusting delay in refunding our money?

It would have been quicker to have booked the holiday separately with my credit card and I would have had all the money back by now. I'll never book anything with ATOL protection again. At least you're covered under the Consumer Act with your credit card. But not with a third party travel agent who is a "Retail Agent for ATOL holders". Not worth the paper it's printed on.

i had a comfirmation letter in oct 2008, i rang them in jan 2009 to see how it was progressing? and they said they need a bit more info. if they new this why wait for my call!! ive sent evrything off they asked for and rang them to see if they had recived it and they had.they couldnt give me any time when this would be proseed.

im so fed up. i dont have spare money to book another holiday, so i am waiting on this money from atol. i do hope its sorted soon.
