vodafone default hell!

hi every one, i do apolagise if im using the forum wrong but this is my first post! have patience pls, i am in need of some help with a situation with vodafone over a 2 year old debt that has resulted in a default on my credit file! the debt was for one of those wireless internet cards for your laptop witch began as a £25 a monthh contract and ended up as a £1456.00 bill in six days!!!! (some kind person hijacked my conection) after fighting them for 6 months it all got to much and was passed on to debt collection agency which i tried to deal with but not very well! anyway after recently applying for credit have found that the best they can offer is around 27%, then contacted the cra,s and found this on my file! i have read a lotsof threads on the subject of fighting the default and my head has been left spinning! is there anyone out there who could please offer any advice on how to go about starting to repair my credit rating to its previously unfaulted state! thanks in advance graham

A couple of points. Firstly write to Vodaphone and the CRA and voice your concern over the default. Add a correction to your credit file stating just what you said above (or similar). Secondly a letter to Vodaphone asking for a copy of any alleged credit agreement along with a copy of the default (there are templates around). Once the have the contract then perhaps it can be looked into further.

If you do a search on the forum for Airtime agreements you may come up with some answers (not sure if what you are talking about would have been an irtime agreement or jsut a bill). From what i remember reading, you need to request a copy of the airtime agreement from the debt collection agency and if they do not have it, then the debt is not enforcable and they should not have passed your details on to the CRA.

, during my preparation for issuing my notice, I discovered that I did not receive either the original default notice at the time you claim it was issued or any deed of assignment as the debt was passed to the Debt Collection Agency. Therefore, under my rights contained within s78 (1) Consumer Credit Act 1974 (s.77 (1)) you must supply me with:
1) A true copy of the alleged agreement you refer to in your letter of 23rd August. Your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee.
2) A signed true and certified copy of the original default notice
3) The deed of assignment as the debt was passed to the debt collection agency.
If you are unable to supply this data then I must insist, further to my Statutory Notice already issued, that you remove the default notice from my credit file.
this is vodafones reply
1. Regarding your assertion that the airtime agreements that you entered into with Vodafone Limited are covered by the consumer credit act 1974 – I have checked with our legal department and they advise that the Vodafone airtime agreement is not a regulated product as defined by that act. Vodafone Limited is not obliged to provide the information that you have requested in your letter of 19 August nor is Vodafone Limited obliged to comply with the timeframes that you have stated
im worried im going to end up being harased for payment again as i havent heard anything about it in a while. think il post the same question over there and see if they can help! thanks! graham0 -
