    Very true BaaB. My DD has the same sort of stuff from school - you have to research it that night and take it in the next day. A real bummer without the internet.

    I don't think :confused:anyone here has won on that argument though - but boundries need to be pushed!
  • There is a way round it though
    31.7.35 Satellite TV and broadband internet contracts

    Ongoing contracts for the supply of goods and services which remain extant at the date of bankruptcy vest in the trustee of the bankruptcy estate. Where the bankrupt is still in receipt of ongoing services under contract at the date of bankruptcy, notice should be given by the official receiver/trustee to the service provider stating that he/she does not wish to adopt the contract and services provided under the contract should cease. This includes contracts for satellite TV or broadband internet connection,where the bankrupt has signed up to the agreement for a set period which cannot be terminated without a penalty being incurred. Any penalty for early cancellation should be included as a debt in the bankruptcy proceedings.

    NB: With the advent of combined telephone and internet packages available via broadband (where telephone services are provided free or at a reduced rate as a result of the broadband service provision), the official receiver should consider whether the expenditure claimed for these combined services may in fact be equal to or less than the cost of a traditional land line only telephone service, which would be considered a reasonable domestic need. However, the need to notify the service provider regarding non-adoption of the contract must still be taken in to account by the official receiver/trustee.

    is this meant to be what we are spending NOW or what we will be spending after BR?
    You have advised me to put down a holiday fund. At the moment we don't have holidays as can't afford it - this is how we got into trouble. Oh is self employed taxi driver. Holidays mean no wages for 1or 2 weeks. That's when the credit cards were useful!
    Now however I am spending on clothes and going out - far more than would be allowed. If the or asks where the money is coming from for these purchases, can I say that I have used our holiday fund for it?
    Some weeks my oh earns more than others, and like fools, we spend the extra instead of paying things off with it.
    I therefore have cash being paid into my bank a/c (as I get a bit carried away with my debit card when I am out shopping) when we have extra left over.
    Basically i want to know if the or will ask where the cash has come from that goes into my account. Can I say our holiday fund?

    Put down a holiday fund anyway. You are permitted to have a small allowance for a holiday. But its your money - if you do not spend it on a holiday then don't. But its an allowance and (rightly or wrongly) the idea is to get your surplus down to as little as possible so that any IPA imposed is as little as possible.

    He probably wont ask, but if he does then yes, you could claim that money spent was saved from a small holiday fund and OH wages. The money was spent on household living and day to day expenses (food/clothes etc).

  • Regarding my SOA. As my bank account is £5k overdrawn the bank charge me about £35 pm in fees. Do I put this on my soa, as once my bank account is closed I won't have these fees any more?

    Yes - the bank account is in debt, therefore you must list them on the creditors list. You are not still using the account are you?? Get another open ASAP - Co-Op cashminder is the best account for BRs.
  • Yes I am using the account as this is where my wages are paid into. By the end of the month the overdraft is up to its limit again tho. Is this wrong? I was going to open a co-op one once I'm br. I will list this on the creditors list, but do I list the charges on my soa or not bother?
