Crapquest threats

I would really appreciate your input,
I received a letter from crapquest concerning my debt of over 1k. It reads:

"Despite our numerous attempts to assist you to find an amicable solution to settle this account, the balance remains unpaid.

Our investigations into your current financial position are now complete and it is unfortunate that we find ourselves preparing a Statutory Demand under section 268(1) (a) of the insolvency act 1986.

It is our intention to issue the statutory demand (form 6.1) on or around **** where it will be personally served upon you.

Once served, the agent will swear an affidavit to the effect that service of the demand has been successful. This is necessary as when a Bankruptcy petition is to be presented based on a statutory demand, then an affidavit verifying service must be filed with the petition for Bankruptcy.

If you do not apply to set aside the Statutory Demand within 18 days or otherwise deal with the demand as set out in the appropriate notes that will be appended to the demand, you could be made Bankrupt and your property and goods taken away from you.

Any application to set aside the demand (Form 6.4 in schedule 4 to the insolvency rules 1986) should be made within 18 days from the date of service upon you and be supported by an affidavit (form 6.5 in schedule 4 to those rules) stating the grounds on which the demand should be set aside. The forms may be obtained from the appropriate court when you attend to make the application.

Remember: from the date of service of the statutory demand
a) You have only 18 days to apply to the court to have the demand set aside and
b) You have only 21 days before we may present a bankruptcy petition

As one last conciliatory gesture, we are offering you the opportunity to clear this account once and for all by paying a settlement of xxx. This is subject to you acceptin gthe offer by ***** 08. This settlement can be over a period of that can be negotiated around your current circumstances. Alternative proposals will also be considered."


The debt probably goes back a couple of years, and they have sent numerous letters to me before, all ignored. I don't have any assets, no home, money, nothing - so why should I fear bankruptcy, and does anybody know if they will actually carry out this threat, seeing as though it costs them about a grand to make me bankrupt, and they probably brought my debt for much less anyway?

Right now, I couldn't give a !!!! anyway.

  • Hello, I have a debt of about £4500 which Capquest are handling. I went to Welfare Rights and they are accepting monthly payments of £10!!!

    Give it a try, what have you got to loose?

    I contacted them and told them I was seeking debt advice and gave them a £5 token payment, it was enough to stall them for a bit and gave me time to sort it all out.

    Are you sure they WONT make me bankrupt? I really dont care about them chasing me anyway, I have absolutely no money.

    No one can be 100% sure what any of the DCA's will do but for a debt of 1k then bankruptcy is unlikely with a debt of 1k and no assets bankruptcy is even more unlikely.

    Is the debt yours?? Could you send them a letter demanding a CCA. You really should not just ingnore it thinking they will go away.

  • I didn't say I think it will go away by ignoring it, but what it will do is wind them up and cost them a lot of money.

    Have you any other debts ? Maybe the best thing for you , start afresh . Lets us know what happens .

    How old is this debt? Could it be statute barred?
    No payments or written acknowledgement of the debt for 6 years (5 in Scotland)

    What was the debt for?
    Have you requested a copy of the customer credit agreement?
