Advice on Dmp

  • Best contact CCCS / NDL for advice.

If you have a DMP it is best to pay the agreed amount that you can afford each month.
If you pay anymore from your bonuses etc. you will put doubt to your original Income and Expenditure Statement.

You may still have reviews / hassle / interest from your creditors though!

An IVA / bankruptcy will stop charges / interest BUT your equity in your house will be in question.

A DMP could last many years, Bankruptcy payment order for 3 years and IVA 5 years.
  • Can I thank every one for there advice , I know now that the DMP is my only choice.:T :T :T
I will ring them on tomorrow and hopefully sort out everything
The only debt I ever want to keep apart from my Mortgage is my car does any one know if you can still get car finance whilst on a DMP.
  • Hi Me again

As far as I am aware you are not allowed to take out any further credit whilst on a DMP so I would say no to getting car finance. You will still be able to keep your existing car though.

You've def done the right thing with a dmp. IVA are expensive and you NEVER ever should swap unsecured loans for secured ( mortgage ) loans.
Like DeepinDebt my mortgage finishes in less than five years and, until then, I will pay the amounts as recommended by CCCS and THEN increase the payments by the same amount as the mortgage and the debt will be gone in a further 24 months making a total of 7 years to freedom, rather than 13 at the present CCCS payments.
It all looks like mountain at the start, but, probably after you've had the chance to remind a few creditors that you are with CCCS, you will realise that what it gives you is a bit more control and the chance to not have your head filled with debt ALL the time.

Keep with it. rememeber to phone CCCS whenever you need them as advice from others on the forums is good ( most of it is correct ) but dont act on any of it without CCCS.

That's great! Good luck and hope everything goes well with the CCCS tomorrow.

Once it's up and running, you can manage your DMP online through the CCCS' web site - you can see statements of your payments to the CCCS, view and amend debt information (e.g. to update a balance or provide details of a debt collection agent), view your budget, download expenditure sheets, get advice on how to deal with creditors, request a review ...

You can also e-mail queries to the CCCS, which is very handy as the phone lines are often very busy. E-mails are usually answered within 24 hours.

    V best wishes.

i agree you do get aggro for a couple of months but that is far far better than the worry of debt before you start a debt managment plan - i could not sleep eat or think anything other that how are we going to sort this huge mess out - then started a debt manangement plan with cccs and i found i could easily cope with letters and calls and could sleep eat and think again!!! - it was like being free again!!!

all i can say is as others have said go for it you will not regret it!!!

Thanks alot !!! I feel better already,it was burying our heads that got us into this mess ,any you think you are the only people in this situation that having had the replies really help:T
I have gots of questions to as the CCCS tomorrow  , but just wondered if anyone knew how i get on when you owes money to the same company i have my mortgage with!!!! Can i still get fixed rates or can they charge me higher interset rates !!!!!
  • I had a lot of advice on a dmp,but something is stopping me !!!!!!! I was wondering can any of the companies phone us at work? I do not really want anyone to know at my work place about mu DMP.

Also can any one reccommend a good bank account i need to get one sorted quickly.
  • if any of your creditors calls you at work just tell them you can't take personal calls, and refuse to answer their security questions, and hang up. Or tell them the person they are asking for is on leave/moved departments etc....if you have caller display, ignore, or pick up/hang up in one move. Pretend you can't hear anyone - say "hello? is there anyone there? " and hang up.

Do anything but don't speak to them at work!!! There is a letter template on here somewhere you can use to tell them not to call you, and that you will only accept written communication (this is your right, OFT guidelines). This means they can't intimidate you unless they're prepared to put it in writing - which they won't, of course!:D

Good bank account - Coop bank, cashminder account - you can use post office as well as branch, online banking, DD's

    Good luck with everything:o

  • here's the phone call stop letters info and useful links - "borrowed" from a post by Ras....

Read the OFT Guidelines first and adapt this letter - quoting the bits about stopping chasing vunerable people.

You need to send a letter telling all the creditors to stop telephoning Him. It may take time to take effect, but if it will work.

So send this first letter registered post. If they make any further calls after it is signed for, then she needs to send the second letter and copy in the Information Commisioner, the OFT and the Trading Standards office nearest the debtor's office.

No it is guaranteed to stop them but if you

1.Point out it is your right under the OFT Guidelines.
    2. refuse to answer security questions.
3.Advise them that you are recoding the call

    they will take the hint.

    Phone letters from fermi

    Something along the lines of:

    Quote:
    Dear Sir / Madam,

    Re accounts ref

I do not acknowledge any debt to your company.

I am writing to you to inform that I request all communications to me in writing. I do not want any further telephone calls made to me ( my mum).

To continue to contact me by telephone after I have requested you not to constitutes harassment. I require all future communications in writing for future Court use. Do not telephone me again – remove any telephone numbers you hold for me from your systems.

Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter, an official complaint, together with a log recording the times and frequency will be passed both to that office and to Trading Standards, For your information, all telephone calls are taped.

This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’. In that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint to the relevant authorities will be made.

Take further notice that continued telephone calls after receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003. Continued phone calls to my mother may also constitute an offence under the Data Protection Act.

Communicate in writing and ONLY in writing. Your telephone calls will not be answered.

HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

I trust I have made myself understood on this matter.

    Yours,

A list of good contacts to whom you can complain formally if they make a nuisance of themselves.

Here are pipk62's list of websites for the organisations .

These addresses are the ones that I have used to find the information that I required, You may want to research pages other than the ones I have linked to, try clicking on the home page if any of these aren't what you wanted.

The Information Commissioners Office, Complaints page: http://www.ico.gov.uk/complaints.aspx
(note: I chose to complete and download the .pdf form on Data Protection, which I am also sending to the other offices, with an accompanying letter)

Trading Standards, Central office homepage: http://www.tradingstandards.gov.uk/
-Please note, you can search by inserting the postcode in the top right hand corner, remember to use the postcode of the DCA rather than your own-

And then if you get any more calls:

    Quote:
    Dear Sir/Madam,

    Ref. 1234567890

Despite my letters regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue.

This behaviour constitutes harassment; the letters stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.

Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office. For your information note that ALL telephone calls are taped.

This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint, containing copies of all correspondence including yours, has now been submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

Communicate in writing and ONLY in writing, your telephone calls will NOT be answered.

HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

I trust that I have made myself understood on this matter,

    Yours faithfully,
