Taking on Debts

Hi

My boyfriend is currently with payplan but it is ruining his credit score due to them having to fairly distribute his money to the creditors so some creditors are getting over their min amount due and some are not getting the minimum amount leading to late payments on his account.

He is wanting to take on some of his creditors independantly so he can ensure that the ones that are receiving late payments get the minimum amount due. Or even with the small ones ask for a settlement amount and try clear them off completely

Payplan have advised that the creditors still left on the plan could find this unfair and take him to court for their money. His debts are currently £20k with the max on one creditor being around £6k.

Can anyone advise if this is true?

thanks

If he is on a DMP with Payplan or CCCS, then he needs to pay the creditors pro-rata.

If he can afford to pay all the creditors their minimum, why is he on a DMP with anyone?

  • Hi

He can't afford to pay the creditors the minimum, i was going to help him pay a couple off completely (through a settlement figure) and then he would be able to pay the minimum on the rest. But he has been advised that if the other creditors find out that he has paid some of the creditors off then they can take him to court and make him pay full amount of outstanding debts, all interest payments and court payments.

Just want to know if we did it this way if his outstanding creditors could take him to court?

    thanks
