Hi all, I have been a long-term lurker on these boards and want to say thanks for all the great advice with regards us getting our first mortgage!
However, this is a different problem completely.
My husband received notification from CapQuest in 2006 saying he owed money to HSBC on 2 accounts. Although he had no clue about these accounts, we were a bit concerned at the mention of baliffs and CCJ's and stupidly made an offer of payment. £25 permonth to one account and £15 per month to the second.
This payment rose every 3 months till we were up to £51 on the 1st acc and £31 on the 2nd. I started looking into the company (which i definitely should have sooner) and requested a copy of the original signed credit agreement from HSBC. They said they were looking into it and would put our acc on hold till it was sorted. The payments were not "held" and were still taken from our bank acc.
I got in touch again with them and requested again the copy of the agreement, and also a copy of all payments made by us so I could tally it against the amount I knew we'd paid.
I received a letter last week saying that they could not provide the agreement for the first acc and that they had cancelled the debt on their system. I checked with our bank and this info is correct (they cancelled the direct debit). We are still awaiting info on the second acc, although I'm almost sure the outcome will be the same.
Now my question is, if we have been paying this acc for 2 years with no "valid" credit agreement, are we entitled to any of this money back? It adds up to a fair bit, and I am absolutely kicking myself for being soo naive as to have believed them in the first place.
If anyone has any clue I'd be very grateful. Thanks in advance..............
