past debts, no bank accounts and off the radar

Dear Forum,
This is my first thread in the hope to finally clear my past debts and become a functioning member of society.

In the year 2000 I got divorced and ended up with over £30.000-£40.000 in debt through mortgages, loans, credit cards and unpaid over drafts. I guess all round debt bombing.

For the past 8 years I have been void of any bank or building society accounts relying on my wages being paid into other peoples accounts.

I now want to deal with my past debts but dont know if any of my debts fall into 'statute barred' due to me not hearing anything from creditors or banks in all these years. I went into the cccs site and filled in one of there questionaires however I couldnt answer any of the questions as they all relate to current debt crisis questioning.

I want to eventually clear my debt and get a mortgage before its too late and would appreciate all the help I can get.

Hello Keller, welcome to the forum :hello:

The best place to start would be to obtain an up to date credit report.
Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional

    Hi

    Start by reading this

Unless you have either made any payments, or acknowledged the debt, in writing, over the last six years, these are likely to be staute barred.

Unless there is a CCJ against the debt and if then it is unleiky that a court would allow a creditor to pursue the case after 6 years (from date of CCJ).

    The problems might be

    a) you could be consideed to have been hiding which make things a bit sticky (if the creditor can prove it).

    b) the mortgage debt - it depends on exactly how the debt came about. In theory they have 12 years to chase you if the debt was secured, but most mortgage companies have undertaken not to pursue debtors after 6 years.

Unfortunately some billions of old mortgage debt was sold last year and some of the less creditable DCAs are trying to pursue people. In practice most would struggle to pursue debtor successfully through the courts.
