Bailiff help please

My husband moved out 4 months ago. We recently had a CCJ for him from a debt before he met me (£15,000). I gave it to him but he has done nothing about it and it's still here. I am trying to phone the courts today to inform them but can't get through and he has just under 2 weeks to send them a varied order form or the bailiffs come.I have a Ford Galaxy which i bought and am paying for (10 months still to pay which I can barely afford... bought with a personal loan). I've just realised he registered it in his name. If I get it transferred into my name am I too late and will they take it if it gets to the bailiff stage? I have five children, have struggled to pay for that car and it seems they will take it for his debt. Should I try and sell it quickly?Help!!

  • I can prove I am paying for it with bank statements will that help?I can't believe he's left such a trail of destruction behind him. If I have no car I can't get the kids to school, ballet, karate etc.... life will stop.

Hi, first off, don't panic. Keep trying the courts, and see what they say. I'm not sure about cars, but they can't take anything that's yours. Maybe get the receipt or the car ready, so you can prove that you bought it. The easiest way orward os simply tell them he's no longer there, give them his new address. Any more post, forward it on rather than wait to give it to him.
This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!

Current Pay Off Target : £1500
  • If you have a utility bill with his name on it, it may be worth paying to get his mail re-directed, that way you won;t have to deal with what comes through your door. Make sure that you keep the receipt.
Also make sure that you notify all and sundry of his new address!!

Actually, I think you may be OK with the car. The log book (V5) registers the KEEPER, not the owner. If you can prove that you bought the car with your money, the bailiff cannot touch it. You need to hunt out your original invoice from where you bought the car and make sure it is your name only. If it is in joint names, I'm afraid you may be stuffed.
I used to think that good grammar is important, but now I know that good wine is importanter.
