Hypothetical Question Re Bankruptcy

Scenario


Wife and husband sperate, apart 18months, no attempt at any legal speration or divorce been dealt with legally just seperation.

Wife decides to petition for BR, most of the debts are joint with husband, if BR is given, does the OR then pass debts onto husband?? and they become his debts after wifes BR declaration??

Wife has no income but Income Support, husband has refused to divorce and is sitting pretty in ex marital home with reasonably hefty bank balance,,, will OR pass debts over to him??:D :rolleyes:

    Yes all debts that are in joint names will pass to the other partner. Thats regardless of whether or not the couple are married :D

    I would imagine that the OR will try to recoup your half of the BI in the property too ;)
