Hello everyone, I have been using some of the CCA template letters to request that Abbey supplies me with a copy of the credit agreement for a credit card, I had sent the second letter sent recorded delivery and a letter came yesterday from one of their compliance officers.
The letter states ( qt ' we enclose a copy of the credit card agreement , including terms and conditions, and statement of account. We are sorry we have not been able to send you a copy of the original but hope you find the enclosed copy clear to read and sufficient for your needs'.)
The was no copy of the agreement or anything signed by me at all enclosed, just a generic terms and conditions for MBNA, and a copy of a statement.
What do I do know in terms of the next stages. Any advice would be appreciated.

Hi Cyril
Have been through some of this so my advice is from experience although others might add in any legal stuff. Firstly did they respond within the time limits? If not then they may have committed an offense.
They have clearly not supplied you with the CCA you have legally requested and so you might want to write back to them stating that they have not supplied the required documents within the allowed timeframe and therefore you will be reporting them to TS and the OFT plus you then make the decision to make any payments. Given that they have produced statements it might make it difficult to argue that you did not enter into an agreement-nonetheless they still have to produce a CCA or copy.
Good luck

They were within the timescales but I thought from reading other threads that unless they have a copy of an original agreement signed by me with other detail etc APR then it wasn't something they could take legal action on. I would obviously rather use my money to pay off other debts that could result in court action ie charging orders etc:beer:0

Hi MBNA accounts are notorious for not having the proper documentation.
When did you take this out?If you've have not made a mistake, you've made nothing0
