Advice Needed

First post and I need help.

I live with my partner and our 2 kids.

Our finances are in a mess - mine slightly better than his but not by much. I only keep my head above water if I get up at 6am each morning and check every detail and see if I can move any of my debt somewhere cheaper and have alerts all over the place.

Last year partner ended up using payplan as he was just unable to meet all of his commitments and he had been receiving the usual letters and phone calls at all time of the day. He works away a lot and I think the companies thought we were telling lies when we answered and said - he's away til next Monday etc.

Anyway the pressures died down and now they have started all up again. From June to August he was hardly at home - maybe 3 nights in total - nature of his job. He is in the process of going over it all again with Payplan but received a court summons from RBS for 3 accounts with them. He has not missied a single payment since he set up the original payments agreed through payplan last year.

He has sent of his statement of incomings/outgoings with the summons to ask for it to continue but is worried sick. So am I. Also the house is in my name only so if the RBS win how do I stop them from coming to the house and trying to take items.

Also he wrote the letters asking for bank charges bank - over £3000 with RBS. Due to the on going court case he has not had anything yet - however he has asked that anything he is due from this be used to repay his debt with them - nothing yet on that so he has also included that in with his summons etc.

Any ideas on what is likely to happen next. I would prefer honesty so that I can do my best to prepare....he is more a head in the sand type of guy and things only get moved on if I continually moan and help prepare the stuff for him - which is not great when he's hardly at home.

All advice appreciated as this is a really difficult time for us.

    I thinkl you need to remind RBS that this is a hardship case and they should not be delaying it, under the new OFT ruling, for a start. if he is with payplan, then he is by definition in dire straits.

    he needs to ask that the court case is transferred to a court near home or work so he can attend and point out that he works away a lot.

    can anyone out there advise if you have reclaimed bank charges and received a payment, can you recall on the same account?
