Buchanan,clark and wells trying it on - Can she just ignore 'em?

Me chum has asked me what to do now - I have given her the best advice I could but I wanted to check with you guys....
In 97 she bought a camera on a store card for £450 - It wasn't the right one so was returned straight away and the card credited..... move quickly forward to June this year
In June 08 she receives threatening letter from BCW demanding the £450. I told her to ignore it or send standard denial letter from here - She does so and they respond by sending her a copy of the credit agreement.
So what, thinks I - It is time barred anyway AND as the camera was returned surely the credit agreement is null and void?
I just want to be sure - Should she now do nothing or should she attempt more communication with BCW? I think do nothing - Make the [STRIKE]!!!!!!!s[/STRIKE] nice gentlemen try and prove it. Am I right?

What was a standard denial letter? A CCA request or a statute barred letter, or..?If you've have not made a mistake, you've made nothing0

We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.
We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

If they call you and bother you; you do the same, let them know what its like. call with private or pay phone and ask them for money they owe_party_ or hang up or call them names (the last one is very entertaining)
If these rats want to be rude and cheeky, we teach them manners.

You can do a search at Companies House which doesn't cost a huge amount, or if you prefer your local library will have software licences for programs which enable you to look the info up free.
Companies House store data on all of the Directors, providing names and home addresses, as well as key contacts at the company (IT, HR etc). BCW have listed about 20 additional contacts.
I wonder how aggressive they would be if you revealed you knew all of this info and were considering paying them a visit to discuss face to face?
My guess is they'd soon shut up...0 -
