When am I actually declared bankrupt?

I thought it was when I went in front of the judge... is this right? Or do I have to wait until after the OR interview?

I have timed things so that I go to court next Wednesday and then have about 3 and half weeks to get the new bank account set up for my salary to be paid in at the end of September ... now I'm worrying that my timing is all wrong. Is it only after the OR interview that I'm bankrupt?

    You are declared bankrupt when in front of the judge and the judge says those words.

    Or f you don't see the judge then from the time they stamp your paperwork on that day (ie in London at the High Court you don't see the judge as there are too many people every day usually, so you give in the paperwork, go away for a couple of hours, come back and collect the paperwork and it's stamped with a time (and that day's date), that's the time and date you went BR

    I never saw the judge,the clerk went in with my SOA and came out with it stamped.All done and dusted in little over 2 hours.D

    Thanks again. I hope mine is as painfree as some of your experiences... I still worry that it won't happen ... I have about £150 a month spare after my allowed for outgoings are counted up .... so I guess there is a chance they will make me pay that each month

    You will pay 50% of £150, so it will be £75 to the OR and £75 to you :)

    Hi Diamond,

    If you have £150 surplus after allowances, you would only pay 50% of it to the OR, so £75.

    Hi,
    You could open your bank account now. You don't have to wait. I opened a Coop cashminder and had £300+ in it. The OR was fine with that.

    With a surplus of £150 are you sure you've claimed for everything? You can't squeeze some more?

    Good luck for Wednesday. You'll be fine. They have drinks machines but you need to take a book! My wait was two hours. :eek:
