Hello everyone,
I am hoping (yet again!) to pick your brains....
I went br in april and own a property with my ex that i thought was empty. We have always been civil and i have tried my best to protect him from my br affecting him.... then things went down hill and over the last few months he has become rather abusive towards me.
so.... I have found out about an hour ago that the property i thought was empty he has had tenants in since May. I wouldn't have a problem with this except he has made me feel so totally awful for not being able to pay much towards the morgage during this time (as recently as last week) and still has all my furniture in another of his propertys that he is refusing to hand over.
My question is.... seeing as i have signed no documentation with the estate agents to allow it to be rented out - is he, or the estate agents acting fraudulently?
Also, with regard to my furniture (its only the bed i want... but i dont have one and i obviously cant afford to buy another!) is there a way i can get it back?
When he bought me out of the property he still owns (2 years ago ish) it was stated that i received reduced equity to account for half the goods in the property (equity minus loan payments to cover my half the sofas, white goods and an ikea loan) he obviously still has these items (and im not interested in taking them) but is there leverage there?
Im so upset he could act this way, i just dont know what to do.... boo

The first thing to do is ask for half the rent received since May (less agency and other costs (but ask for proof)) and obviously a new rental agreement that ensures half the monthly rents come directly to you. Then, separately, make an agreement re the mortgage payments.

thanks rich... im on the case now re: a solicitor. With regard new agreements, my ex wont tell me who its rented out through so im currently on the hunt through the yellow pages to find this info out.
I think the worst part is that i trusted him and i feel a bit silly for letting him do that.BSC: No: 1050 -

Fair enough, but once trust has gone it's gone so this is just like any other commercial deal now.
If you can't find who is organising the letting or what the rent is, your solicitor would probably advise just to send a claim for the going market rent for your area and leave it to him to prove otherwise.Gt NW 1/2 Marathon 21/2/2010 (Target=1:22:59) (6:20/mile) 1:22:47 (6:19):j:j
