Gerurdeanna's getting back on track thread!!

My and OH are splitting up, he is moving out next week. He's already cleared the joint bank account out once and I have applied for Income Support and single Child Tax Credit.
We were dealing with the CAB about a year ago, I have tried to go back to them but they are really really busy and the waiting list is ages!! Is CCCS any good?
I've been trying to fill in the online help form but will need to contact all the creditors to see if the are joint or single debts - lots of ringing round this pm I think. I will fill them all in on the situation and hope they have sympathy!!
I'm not expecting thousands of replies but a hello every now and again would be good!! hehe!!
Once I've finished with the online help form, I'll post my SOA and see if we can pick at it even more (with your help of course!!)
I do think though that at the moment with almost £35k of debt - it maybe best to go bankrupt??

    Sorry to hear about you and your OH, but sounds like you are taking very positive steps forward.

    I would definitely suggest contacting all your creditors and filling in the online form for CCCS. You could also try contacting National Debtline (www.nationaldebtline.co.uk) who are also a free charity.

    Good luck with the SOA, im sure you will get loads of support.

    Do you think this looks ok? I've followed the CAB SOA they produce for us last year and updated figures etc.

    Does anyone have a template letter to send to my creditors with my proposed repayments? Nobody has changed actually, its just the Nursery that has been added in (but they aren't actually chasing atm, and I've been told that in all probablilty they won't....should I leave them out until they do??)

    Hi & welcome,

    I seem to remember that there are templates on the CCCS website, if you do an online budget then the letter comes up in the 'solution'. If not then I think there'll be one on this website somewhere.

    The thing I noticed was that your telephone & interenet charges are quite gigh at £14 a week. How about trying to get an all in one package, I'm curretnly paying £30 for the virgin 'phone, tv & intenet package. I believe sky also do one similar.

  • My internet is £18 per month, services ie line rental and tv are £35.00 and the extra is calls.
    I do need to get that down, but I'm tied into a contract for another 6 months and if I can anything, I've been told I have to pay £60 per month!!!!

    IMoneyManager seems like a good program, but its asking me to propose repayments at £0.40 for the BT debt of £117.44, now I pretty sure that no creditor is going to accept less than £1.00 per month, is that right?
    Should I tweak it a bit?
    I really want to get this sorted now, cos I'm not sleeping very well and am scared of answering the phone!!

    Have a look at the price comparison sites to see if you can get a better deal for the utilities.

    Have you looked at the old style board for mealplan ideas? Might be able to reduce the grocery bill a little.

    I think you are right to have £1 as the minimum payment to each debt.
    (Have you checked to see what debts are in your name and which are in OH's?)

(Probably not statute barred, but worth asking) The CAB knew I was in arrears with the Nursery, but now the children don't go as the Nursery refused entry for them, so in that respects its a recent debt. Last payment was probably June ish of this year so not statue barred. And I really am unsure of whether to include or not, I have 'inside' knowledge who suggest the Nursery will write the debt off....I have a letter rom them 3 months ago advising me to pay in within 2 weeks or they would take it further, they haven't but thats no guarentee that they won't.

    I would personally speak again to CAB (did they help set up the plan or are they actually dealing with it)?The CAB helped set up the original plan 2 years ago and everything was being paid fine upto when my OH and I split and then for about 2 months I had no money coming in at all.

    It might be best not to rock the boat with regards the payments - if the nursery aren't chasing you right now, you could perhaps put that money aside into a seperate account.

    With regards the CCA requests, the debt is never written off, but you may be able to show that it is unenforcable if they are unable to to provide a copy of the credit agreement or if it doesn't contain all the prescribed terms.

    I would try and get something in writing and try and get some help from a solicitor. Your ex is amicable right now but you don't want to be left trying to pay the mortgage as well and if your ex doesn't pay you need to have it in writing that he has agreed to pay it so they don't chase you for it - especially if you are still living in the house.
