hello all,
ive been looking at this site for some time in order to make decisions over my debts, and after reading many posts ive come to the decision that i really need to go bankrupt. but ive got a couple of questions..
ive downloaded and filled in the form 6.28 SOA and also form 6.27 DBP, im assuming i just leave the business questions blank. ill be contacting the court on tuesday to see when i can take them in.. question1; if they give me a date to take them, is this when ill have to pay my costs and then be declared bankrupt??
ive just opened a co-op cashminder account (as the abbey have been crippling me with charges for the last 18months...£300 last month, and now theyre withdrawing my overdraft facility... anyway thats another story) question2; will i be allowed to have my wages paid into this account to pay rent, bills etc or will i need to get my wages paid elsewhere, say a friends account or something when im declared bankrupt?? as i keep reading about your accounts being frozen..

They normally advise that you open a basic account with The Co-Op on the same day as your bankruptcy to avoid it being frozen with everything else. Ring the court your wanting to petition in & make an appt to petition for BR..this can take a few weeks/a few days or in some courts cases a walk in service....soon as you get your appt just take 3 copies of your paperwork & funds & thats it
Co-op cashminder accounts are rarely frozen BUT there is always the odd exeption, list the accouny on your paperwork & hopefully the OR wont touch the account as they see it as a basic account....."IF" and its a big if the account by chance is frozen the OR can easily sort this with one quick phonecall to the bank..meanwhile they can authorise release of funds straight away if needs be...We all die. I had to take my forms in and pay my money and then go back a few days later to see the judge, It all depends on the court but just ask them when you call.
As for bank accounts you have to open a basic account which has no overdraft etc and your wages can be payed into it. As for being frozen they sometimes do this but not always it really depends on the bank. My account with abbey was not frozen.

You should be fine opening a Coop account and having your wages, direct debits etc. I've only heard of one case where it was frozen and it was quickly sorted out. Be sure you tell your OR that you opened the basic account when you knew you were going bankrupt.
If you don't have a business then leave those questions blank.
Have you taken advice from CCCS or NAtional Debtline? If not I suggest you ring them ASAP to discuss it with them. You may be asked if you have taken advice and if not, they could postpone your bankruptcy.
You don't pay the fees until you go in with your papers. Your court may operate on an appointments system or just turn up.

i cant get paid in cash but could probably get my wages paid into a friends account.
i havent used the co-op account yet as im still waiting for card etc and no money has been paid into it. im just wondering if this account could be unfrozen and then used during the bankruptcy.0 -

originally i wanted to do an IVA but after talking to payplan and CCCS they suggested the bankruptcy route as it should be very straight forward and id be on my feet a whole load quicker.

As long as you've had advice from cccs etc you'll be fine.......once you get your court date everything happens pretty fast, you'll look back on this in a few months & wonder what all the fuss was about!!
